| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, in budget and finance, |
3 | further providing for Commonwealth portion of fines. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 3571(b)(2) of Title 42 of the |
7 | Pennsylvania Consolidated Statutes is amended and the subsection |
8 | is amended by adding a paragraph to read: |
9 | § 3571. Commonwealth portion of fines, etc. |

11 | (b) Vehicle offenses.-- |

13 | (2) (i) Except as provided in [paragraph (4)] | <-- |
14 | paragraphs (4) and (5), when prosecution under any other |
15 | provision of Title 75 (relating to vehicles) is the |
16 | result of State Police action, all fines, forfeited |
17 | (2) Except as provided in [paragraph (4)] paragraphs (4) | <-- |
18 | and (5), when prosecution under any other provision of Title |

1 | 75 (relating to vehicles) is the result of State Police |
2 | action, all of the following apply: |
3 | (i) All fines, forfeited recognizances and other |
4 | forfeitures imposed, lost or forfeited shall be payable |
5 | to the Commonwealth, for credit to the Motor License |
6 | Fund. One-half of the revenue shall be paid to |
7 | municipalities as designated in subparagraph (ii) in the |
8 | same ratio provided in section 4 of the act of June 1, |
9 | 1956 (1955 P.L.1944, No.655), [relating to partial |
10 | allocation of liquid fuels and fuel use tax proceeds.] |
11 | referred to as the Liquid Fuels Tax Municipal Allocation |
12 | Law. |
13 | (ii) (A) Only municipalities that provide at least | <-- |
14 | (ii) Distribution of revenue is as follows: | <-- |
15 | (A) Only a municipality that has a population of |
16 | not more than 3,000 or that provides at least 40 |
17 | hours per week of local police services through a |
18 | municipal police department, participation in a |
19 | regional police department or contracts with other |
20 | municipal or regional police for police services may |
21 | receive revenue under subparagraph (i). |
22 | (B) Revenue that is not paid to municipalities |
23 | under clause (A) shall be transferred to the |
24 | Pennsylvania State Police for cadet classes. |

26 | (5) When prosecution under any other provision of Title |
27 | 75 is the result of State Police action on an interstate |
28 | highway, as defined in 75 Pa.C.S. § 102 (relating to |
29 | definitions), all fines, forfeited recognizances and other |
30 | forfeitures imposed, lost or forfeited shall be payable to |

1 | the Commonwealth, for credit to the Motor License Fund. |
2 | Section 2. This act shall take effect in 60 days. |
