| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, prohibiting obscene displays on and in motor |
3 | vehicles. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 75 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 4538. Obscene displays on and in motor vehicles. |
9 | (a) General rule.--No owner of a motor vehicle shall display |
10 | on or in the motor vehicle a motion picture, bumper sticker, |
11 | window sign or other marking that is obscene or depicts sexual |
12 | conduct and that may be visible to the driver of another motor |
13 | vehicle. |
14 | (b) Penalty.--A person who violates this section commits a |
15 | summary offense and shall, upon conviction, be sentenced to pay |
16 | a fine of not less than $100. |
17 | (c) Definitions.--As used in this section, the following |
18 | words and phrases shall have the meanings given to them in this |

1 | subsection unless the context clearly indicates otherwise: |
2 | "Obscene." As defined in 18 Pa.C.S. § 5903(b) (relating to |
3 | obscene and other sexual materials and performances). |
4 | "Sexual conduct." As defined in 18 Pa.C.S. § 5903(b). |
5 | Section 2. This act shall take effect in 60 days. |
