| A RESOLUTION |
| |
1 | Memorializing the Mayor of Philadelphia to prohibit any employee |
2 | of the School District of Philadelphia from giving himself or |
3 | herself an extension of contract, a raise or a bonus by |
4 | contract or otherwise unless the General Assembly permits |
5 | such action under the Public School Code of 1949. |
6 | WHEREAS, The School District of the City of Philadelphia, |
7 | like governments everywhere, is struggling financially and is |
8 | cutting $49 million from this year's $3.2 billion budget and |
9 | decreasing at least $400 million next year; and |
10 | WHEREAS, In the midst of the layoffs, school closings, hiring |
11 | freezes, larger class sizes and other cutbacks these large |
12 | spending decreases will necessitate, School Superintendent |
13 | Arlene Ackerman continues to draw her generous salary of |
14 | $348,000 and, in fact, can draw an additional $100,000 bonus in |
15 | accordance with her contract; and |
16 | WHEREAS, Nowhere in the Public School Code of 1949 does State |
17 | law allow a school employee to extend his or her own contract or |
18 | give oneself a raise or a bonus, and yet those unconscionable |
19 | allowances are exactly what Superintendent Ackerman's contract |

1 | allows her to do; and |
2 | WHEREAS, Section 17 of Article I of the Constitution of |
3 | Pennsylvania prohibits the impairment of contracts by the |
4 | General Assembly, but this prohibition anticipates not only the |
5 | fairness of the contract but also the fairness of its execution; |
6 | therefore be it |
7 | RESOLVED, That the House of Representatives memorialize the |
8 | Mayor of Philadelphia to prohibit any employee of the School |
9 | District of Philadelphia from giving himself or herself an |
10 | extension of contract, a raise or a bonus by contract or |
11 | otherwise, unless the General Assembly permits such action under |
12 | the Public School Code of 1949. |
