AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, further providing for additional parking

3

regulations.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 3354(d)(3)(i) and (e) of Title 75 of the

7

Pennsylvania Consolidated Statutes are amended to read:

8

§ 3354.  Additional parking regulations.

(d)  Person with a disability and disabled veterans.--

(3)  (i)  Except for persons parking vehicles lawfully

13

bearing a person with a disability, disabled veteran or

14

severely disabled veteran registration plate or

15

displaying a person with a disability or severely

16

disabled veteran parking placard when such vehicles are

17

being operated by or for the transportation of a person

18

with a disability, a disabled veteran or a severely

disabled veteran, no person shall park a vehicle on

2

public or private property reserved for a person with a

3

disability, disabled veteran or severely disabled veteran

4

which property has been so posted in accordance with

5

departmental regulations. Regulations shall require that

6

parking spaces designated with an international symbol

7

for access for persons with disabilities on a sign are

8

posted with a sign stating the penalty amount indicated

9

in subsection (f) and that vehicles in violation of the

10

subsection may be towed and require that signs be

11

replaced when they become either obsolete or missing with

12

all costs to replace the necessary signs to be borne by

13

the persons responsible for signing the particular

14

location. The absence of a sign stating the penalty

15

amount at parking spaces designated with an international

16

symbol for access for persons with disabilities shall not

17

preclude the enforcement of this subsection. A vehicle

18

which is unlawfully parked in a designated person with a

19

disability parking area may be removed from that area by

20

towing and may be reclaimed by the vehicle owner upon

21

payment of the towing costs. A vehicle may only be towed

22

under this paragraph if the parking space is posted with

23

a sign indicating that vehicles in violation of this

24

section may be towed.

(e)  Unauthorized use.--

(1)  An operator of a vehicle bearing a person with a

28

disability, disabled veteran or severely disabled veteran

29

plate [or displaying a person with a disability or severely

30

disabled veteran parking placard] shall not make use of the

parking privileges accorded to a person with a disability,

2

disabled veterans and severely disabled veterans under

3

subsection (d)(3) unless the operator is a person with a

4

disability, a disabled veteran or a severely disabled veteran

5

or unless the vehicle is being operated for the

6

transportation of a person with a disability, disabled

7

veteran or severely disabled veteran.

(2)  An operator of a vehicle displaying a person with a

9

disability or severely disabled veteran parking placard shall

10

not make use of the parking privileges accorded to a person

11

with a disability and a severely disabled veteran under

12

subsection (d)(3) unless the operator is a person with a

13

disability or a severely disabled veteran or unless the

14

vehicle is being operated for the transportation of a person

15

with a disability or a severely disabled veteran.

Section 2.  This act shall take effect in 60 days.
