AN ACT

Amending Title 40 (Insurance) of the Pennsylvania Consolidated

2

Statutes, in hospital plan corporations, further providing

3

for definitions and for certification of hospital plan

4

corporations; and, in professional health services plan

5

corporations, further providing for definitions and for

6

certification of professional health service corporations.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  Section 6101 of Title 40 of the Pennsylvania

10

Consolidated Statutes is amended by adding a definition to read:

11

§ 6101.  Definitions.

12

The following words and phrases when used in this chapter

13

shall have, unless the context clearly indicates otherwise, the

14

meanings given to them in this section:

15

"Affiliate."  A domestic or foreign corporation, association,

16

trust or other organization:

17

(1)  that owns a 10% or greater interest in a hospital

18

plan corporation; or

19

(2)  in which a hospital plan corporation owns a 10% or

20

greater interest.

Section 2.  Section 6102(a) and (d) of Title 40 are amended

3

to read:

§ 6102.  Certification of hospital plan corporations.

(a)  General rule.--A corporation not-for-profit incorporated

6

for the purpose of establishing, maintaining and operating a

7

nonprofit hospital plan shall not commence business until it

8

shall have received from the department a certificate of

9

authority authorizing the corporation to establish, maintain and

10

operate such a nonprofit hospital plan. A corporation not-for-

11

profit may not establish, maintain or operate a nonprofit

12

hospital plan if the corporation or affiliate is certified as a

13

professional health services corporation under section 6304

14

(relating to certification of professional health service         

15

corporations).

(d)  Standards for issuance of certificate.--A certificate of

18

authority shall be issued by order of the department only if and

19

when the department shall find and determine that the

20

application complies with the provisions of this chapter and the

21

regulations of the department thereunder. The department may not

22

issue a certificate of authority to a corporation not-for-profit

23

if the corporation or an affiliate is certified as a

24

professional health services corporation under section 6304.

Section 3.  Section 6302(a) of Title 40 is amended by adding

27

a definition to read:

§ 6302.  Definitions.

(a)  General rule.--The following words and phrases when used

otherwise, the meanings given to them in this section:

Section 4.  Section 6304(a) and (c) of Title 40 are amended

10

to read:

§ 6304.  Certification of professional health service         

12

corporations.

(a)  General rule.--A corporation not-for-profit incorporated

14

for the purpose of establishing, maintaining and operating a

15

nonprofit professional health service plan, nonprofit dental

16

service plan or nonprofit optometric service plan shall not

17

commence business until it shall have received from the

18

department a certificate of authority authorizing the

19

corporation to establish, maintain and operate a nonprofit

20

professional health service plan, a nonprofit dental service

21

plan or a nonprofit optometric service plan, as the case may be.

22

A corporation not-for-profit may not establish, maintain or

23

operate a nonprofit professional health service plan, a

24

nonprofit dental service plan or a nonprofit optometric service

25

plan if the corporation or affiliate is certified as a hospital

26

plan corporation under section 6102 (relating to certification

27

of hospital plan corporations).

(c)  Form of application.--Every application for a

30

certificate of authority under this section shall be made to the

Insurance Department in writing and shall be in such form and

2

contain such information as the regulations of the Department of

3

Health and the Insurance Department may require. The Insurance

4

Department shall forward the application to the Department of

5

Health for action thereon and report to the Insurance

6

Department. The Insurance Department may not forward an

7

application to the Department of Health if the applicant or an

8

affiliate is certified as a hospital plan corporation under

9

section 6102.

Section 5.  This act shall take effect in 60 days.
