AN ACT

Amending the act of September 30, 1983 (P.L.160, No.39),

2

entitled "An act establishing salaries and compensation of

3

certain public officials including justices and judges of

4

Statewide courts, judges of courts of common pleas, judges of

5

the Philadelphia Municipal Court, judges of the Philadelphia

6

Traffic Court, district justices and the Governor, the

7

Lieutenant Governor, the State Treasurer, the Auditor

8

General, the Attorney General and certain other State

9

officers and the salary and certain expenses of the members

10

of the General Assembly; and repealing certain inconsistent

11

acts," providing for limitations on certain additional

12

expenses of the General Assembly.

The General Assembly of the Commonwealth of Pennsylvania

14

hereby enacts as follows:

Section 1.  The act of September 30, 1983 (P.L.160, No.39),

16

known as the Public Official Compensation Law, is amended by

17

adding a section to read:

Section 5.3.  Limitations on certain additional expenses of the

19

General Assembly.

(a)  Prohibition on per diem payments.--Any payment made to a

21

member of the General Assembly that is a per diem payment, or

22

would be considered a per diem payment under the Internal

Revenue Code of 1986 (Public Law 99-514, 26 U.S.C. § 1 et seq.),

2

for days of service shall be prohibited. Only actual expenses

3

shall be reimbursable to an individual member upon the receipt

4

of documentation of the expense.

(b)  Limitations.--This section shall only apply to payments

6

made for individual days of service. This section shall not

7

impact any other form of compensation including salary, benefits

8

or reimbursed expenses.

Section 2.  All rules and regulations inconsistent with this

10

act are abrogated insofar as the rule or regulation is

11

inconsistent with the act.

Section 3.  This act shall take effect in 60 days.
