AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, in firearms and other dangerous

3

articles, prohibiting certain assault weapons.

4

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 18 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 6121.1.  Certain assault weapons prohibited.

(a)  Offense defined.--Except as set forth in subsection (b),

10

a person may not do any of the following:

11

(1)  Possess, use, control, sell, transfer or manufacture

12

an assault weapon or obtain a license to possess, use,

13

control, sell, transfer or manufacture an assault weapon.

14

(2)  Obtain a license to do, in this Commonwealth, any of

15

the acts under paragraph (1).

16

(b)  Exception.--Subsection (a) shall not apply to a member

17

of the armed forces of the United States or the National Guard

18

or a law enforcement officer while performing official duties or

traveling to or from an authorized place of duty if possession

2

of the assault weapon is authorized under applicable statute,

3

regulation or military or law enforcement policy.

(c)  Definition.--As used in this section, the term "assault

5

weapon" means:

6

(1)  a semiautomatic rifle known as an SKS with

7

detachable magazine;

8

(2)  a part or combination of parts designed or intended

9

to convert a firearm into a weapon described in paragraph

10

(1); or

11

(3)  a combination of parts, in possession or under

12

control of the same person, from which a weapon described in

13

paragraph (1) may be readily assembled.

14

Section 2.  This act shall take effect in 60 days.
