AN ACT

Providing for the adoption of capital projects related to flood

2

disaster railroad assistance projects.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Short title.

6

This act shall be known and may be cited as the Flood

7

Disaster Railroad Assistance Project Itemization Act of 2012.

8

Section 2.  Definitions.

9

The following words and phrases when used in this act shall

10

have the meanings given to them in this section unless the

11

context clearly indicates otherwise:

12

"Disaster."  The period of time in calendar year 2011

13

relating to Hurricane Irene and Tropical Storm Lee that was the

14

subject of a presidential declaration of an emergency under The

15

Robert T. Stafford Disaster Relief and Emergency Assistance Act

16

(Public Law 93-288, 88 Stat. 143).

Section 3.  Total authorization.

The total authorization for disaster assistance projects to

2

be financed in part with grants as itemized in this act is

3

$2,600,000.

Section 4.  Itemization of disaster assistance projects.

5

The individual disaster assistance projects to be financed

6

from current revenues are hereby itemized, together with their

7

respective estimated financial costs, as follows:

8

Department of Transportation        $2,600,000

9

(1)  Lycoming Valley Railroad        1,000,000

10

(2)  Delaware & Hudson Railway       1,600,000

11

Section 5.  Funds.

12

The projects itemized in this act shall be funded from

13

current revenues of the General Fund the current amount

appropriated for General Fund rail freight assistance.

15

Section 6.  Federal funds.

16

All moneys received from the Federal Government for the

17

projects specifically itemized in this act are also hereby

18

appropriated for those projects.

Section 7.  Construction.

20

Amounts contained in this act for any project shall not

21

supplant or replace any Federal funds authorized by any Federal

22

law or regulation. Funding from this act for any project is

23

available only to the extent that Federal funds are not

24

available for such project.

25

Section 8.  Effective date.

26

This act shall take effect immediately.
