| AN ACT |
| |
1 | Providing for the adoption of capital projects related to flood |
2 | disaster railroad assistance projects. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Short title. |
6 | This act shall be known and may be cited as the Flood |
7 | Disaster Railroad Assistance Project Itemization Act of 2012. |
8 | Section 2. Definitions. |
9 | The following words and phrases when used in this act shall |
10 | have the meanings given to them in this section unless the |
11 | context clearly indicates otherwise: |
12 | "Disaster." The period of time in calendar year 2011 |
13 | relating to Hurricane Irene and Tropical Storm Lee that was the |
14 | subject of a presidential declaration of an emergency under The |
15 | Robert T. Stafford Disaster Relief and Emergency Assistance Act |
16 | (Public Law 93-288, 88 Stat. 143). |
17 | Section 3. Total authorization. |
18 | The total authorization for disaster assistance projects to |

1 | be financed in part with grants as itemized in this act is |
2 | $2,600,000. |
3 | Section 4. Itemization of disaster assistance projects. |
4 | The individual disaster assistance projects to be financed |
5 | from current revenues are hereby itemized, together with their |
6 | respective estimated financial costs, as follows: |
7 | Department of Transportation $2,600,000 |
8 | (1) Lycoming Valley Railroad 1,000,000 |
9 | (2) Delaware & Hudson Railway 1,600,000 |
10 | Section 5. Funds. |
11 | The projects itemized in this act shall be funded from |
12 | current revenues of the General Fund. |
13 | Section 6. Federal funds. |
14 | All moneys received from the Federal Government for the |
15 | projects specifically itemized in this act are also hereby |
16 | appropriated for those projects. |
17 | Section 7. Construction. |
18 | Amounts contained in this act for any project shall not |
19 | supplant or replace any Federal funds authorized by any Federal |
20 | law or regulation. Funding from this act for any project is |
21 | available only to the extent that Federal funds are not |
22 | available for such project. |
23 | Section 8. Effective date. |
24 | This act shall take effect immediately. |
