AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

Statutes, further providing for definitions; and providing

3

for special rules for bicycles.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 102 of Title 75 of the Pennsylvania

7

Consolidated Statutes is amended by adding a definition to read:

8

§ 102.  Definitions.

9

Subject to additional definitions contained in subsequent

10

provisions of this title which are applicable to specific

11

provisions of this title, the following words and phrases when

12

used in this title shall have, unless the context clearly

13

indicates otherwise, the meanings given to them in this section:

"Bicycle."  Every vehicle propelled solely by human power,

16

and every motorized bicycle propelled by a combination of human

17

power and an electric helper motor capable of propelling the

18

vehicle at a speed of not more than 20 miles per hour on level

ground upon which any person may ride, having two tandem wheels,

2

and including any device generally recognized as a bicycle

3

though equipped with two front or two rear wheels. The term does

4

not include a vehicle with a seat height of no more than 25

5

inches from the ground when the seat is adjusted to its highest

6

position or a scooter or similar device.

Section 2.  Chapter 35 of Title 75 is amended by adding a

9

subchapter to read:

3591.  Operating a motorized bicycle.

No person under 16 years of age may operate or ride upon a

16

motorized bicycle.

Section 3.  This act shall take effect in 60 days.
