AN ACT

Providing for performance audits of Commonwealth agencies and

2

for the powers and duties of the Auditor General.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Short title.

6

This act shall be known and may be cited as the Commonwealth

7

Agency Performance Audit Act.

8

Section 2.  Definitions.

9

The following words and phrases when used in this act shall

10

have the meanings given to them in this section unless the

11

context clearly indicates otherwise:

12

"Commonwealth agency."  Any of the following:

13

(1)  Any agency, board, bureau, commission, committee,

14

council, department, office or similar unit of the executive

15

branch.

16

(2)  Any board, commission or other agency or officer of

17

the Commonwealth that is not subject to the policy

supervision and control of the Governor.

2

(3)  Any legislative agency.

3

The term shall not include a State–related university or

4

judicial agency.

5

"Judicial agency."  A court of this Commonwealth or any other

6

entity or office of the unified judicial system.

7

"Legislative agency."  Any of the following:

8

(1)  The Center for Rural Pennsylvania.

9

(2)  The Joint Legislative Air and Water Pollution

10

Control and Conservation Committee.

11

(3)  The Joint State Government Commission.

12

(4)  The Legislative Budget and Finance Committee.

13

(5)  The Legislative Data Processing Committee.

14

(6)  The Independent Regulatory Review Commission.

15

(7)  The Legislative Reference Bureau.

16

(8)  The Local Government Commission.

17

(9)  The Pennsylvania Commission on Sentencing.

18

(10)  The Legislative Reapportionment Commission.

19

(11)  The Legislative Audit Advisory Commission.

"Performance audit."  A written report evaluating the

21

management and performance of a Commonwealth agency to determine

22

whether the Commonwealth agency is conducting:

23

(1)  Programs and activities in a manner consistent with

24

accomplishing the objectives intended by the General

25

Assembly.

26

(2)  Programs and activities and expending funds made

27

available in an efficient, economical and effective manner.

28

"State-related universities."  The term includes:

29

(1)  Temple University.

(2)  The University of Pittsburgh.

(3)  The Pennsylvania State University.

(4)  Lincoln University.

Section 3.  Auditor General.

The Auditor General shall conduct a performance audit for

5

each Commonwealth agency as follows:

6

(1)  The performance audit shall be completed within one

7

year of the effective date of this section.

8

(2)  The performance audit shall include recommendations

9

as to whether the Commonwealth agency should be continued,

10

terminated, altered or consolidated with other Commonwealth

11

agencies.

12

(3)    The performance audit shall be posted on the

13

PennWATCH website.

14

(4)  Each member of the General Assembly and the Governor

15

shall be notified when the performance audit is posted on the

16

PennWATCH website.

Section 4.  Effective date.

18

This act shall take effect immediately.
