AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," providing for contracts to promote

6

participation.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  The act of March 10, 1949 (P.L.30, No.14), known

10

as the Public School Code of 1949, is amended by adding a

11

section to read:

Section 761.  Contracts to Promote Participation.--(a)  The

13

board of school directors of each school district shall develop,

14

adopt and implement binding policies or guidelines to ensure

15

that all persons are accorded equal opportunity in contracting

16

and subcontracting associated with any public contract for the

17

construction, reconstruction, alteration or repair of any school

18

district building or other such public work or for the

19

completion of any project or performance of any other work

20

whatsoever and the purchase of any materials, equipment or any

other supplies for the use of the public school in accordance

2

with section 807.1.

(b)  Every contract for or on behalf of a school district for

4

the construction, reconstruction, alteration or repair of any

5

school district building or other such public work or for the

6

completion of any project or performance of any other work or

7

purchases for the use of the school district shall contain

8

provisions by which the contractor agrees to promote, increase

9

and sustain contracting and subcontracting opportunities for

10

disadvantaged businesses.

11

(c)  The board of school directors of each school district

12

shall ensure that a written record is made of each written or

13

telephonic price quotation that requires advertisement and

14

competitive bidding. Written price quotations and written

15

records of telephonic price quotations and memoranda shall be

16

retained for a period of three years. The written record shall

17

include, but not be limited to:

18

(1)  The date of the quotation.

19

(2)  The name and address of any disadvantaged small business

20

which is participating in the performance of the contract.

21

(3)  Information concerning the contract which is subject to

22

written or telephonic price quotation.

23

(4)  The monetary value of the contract.

24

(d)  This section shall apply to:

25

(1)  Any school district contract which is subject to

26

competitive bidding.

27

(2)  Any written or telephonic price quotation which requires

28

advertisement and competitive bidding in accordance with the

29

requirements of this act.

(3)  All school district contractors, subcontractors,

assignees, lessees, agents, vendors and suppliers.

(4)  The purchase of supplies for the use of public schools

3

in accordance with section 807.1.

4

(5)  Any disadvantaged business.

5

(e)  The board of school directors of each school district

6

may use the lists of certified minority-owned, women-owned and

7

veteran-owned business enterprises which have been certified

8

under the Department of General Services' disadvantaged business

9

program to compete for and participate in the school district's

10

contracting process. The Department of General Services shall

11

cooperate with and assist the board in carrying out the

12

requirements of this subsection.

(f)  For the purpose of this section, the following words and

14

phrases shall have the meanings given to them in this section

15

unless the context clearly indicates otherwise:

16

"Disadvantaged business."  A small business which is owned or

17

controlled by a majority of persons, not limited to members of

18

minority groups, who:

19

(1)  have been deprived of the opportunity to develop and

20

maintain a competitive position in the economy because of social

21

disadvantages; or

22

(2)  are veterans, including service-disabled veterans.

23

"Service-disabled veteran."  A veteran who possesses either

24

an adjudication letter from the Department of Veterans Affairs

25

establishing a service-connected disability rating or a

26

disability determination from the Department of Defense.

27

"Small business."  The term shall have the meaning given to

28

it in 62 Pa.C.S. § 2102 (relating to definitions).

29

"Veteran."  An individual who:

30

(1)  served in the active United States military in any of

the four current branches and all previous branches, including a

2

reserve component or the National Guard;

3

(2)  was released or discharged from active military service

4

under conditions other than dishonorable; and

5

(3)  possesses a certificate of release or discharge from

6

active duty.

7

Section 2.  This act shall take effect in 60 days.
