| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, in minors, providing for the offense |
3 | of selling or furnishing spray paint to minors. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 18 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 6316.1. Selling or furnishing spray paint to minors. |
9 | (a) Offense defined.--A person commits a summary offense if |
10 | he knowingly sells or furnishes or purchases with the intent to |
11 | sell or furnish spray paint to a person who is less than 18 |
12 | years of age, except where the relationship of parent and child, |
13 | guardian and ward or adult instructor and pupil exists between |
14 | such person and the person who is less than 18 years of age. |
15 | (b) Penalty.--A person who is convicted of violating |
16 | subsection (a) shall be sentenced to pay a fine of not less than |
17 | $250 for the first violation and a fine of $500 for each |
18 | subsequent violation. |

1 | (c) Definition.--As used in this section, "spray paint" |
2 | shall mean a sealed pressurized container that holds paint and |
3 | from which paint is released in a fine spray mist by depressing |
4 | a valve button. |
5 | Section 2. This act shall take effect in 60 days. |
