AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

Consolidated Statutes, in minors, providing for the offense

3

of selling or furnishing spray paint to minors.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Title 18 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 6316.1.  Selling or furnishing spray paint to minors.

(a)  Offense defined.--A person commits a summary offense if

10

he knowingly sells or furnishes or purchases with the intent to

11

sell or furnish spray paint to a person who is less than 18

12

years of age, except where the relationship of parent and child,

13

guardian and ward or adult instructor and pupil exists between

14

such person and the person who is less than 18 years of age.

(b)  Penalty.--A person who is convicted of violating

16

subsection (a) shall be sentenced to pay a fine of not less than

17

$250 for the first violation and a fine of $500 for each

18

subsequent violation.

(c)  Definition.--As used in this section, "spray paint"

2

shall mean a sealed pressurized container that holds paint and

3

from which paint is released in a fine spray mist by depressing

4

a valve button.

Section 2.  This act shall take effect in 60 days.
