| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in interscholastic athletic |
6 | accountability, providing for participation by nonpublic |
7 | schools and private schools and for required divisions. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. The act of March 10, 1949 (P.L.30, No.14), known |
11 | as the Public School Code of 1949, is amended by adding sections |
12 | to read: |
13 | Section 1606-A. Participation by Nonpublic Schools and |
14 | Private Schools.--(a) No nonpublic school or private school |
15 | that offers scholarships or tuition assistance to students |
16 | enrolled in the nonpublic school or private school may |
17 | participate in interscholastic athletic playoffs or |
18 | championships between public schools. |
19 | (b) Nothing in this section shall be construed to prohibit a |
20 | nonpublic school or private school from participating in regular |

1 | season play of interscholastic athletics with public schools. |
2 | Section 1607-A. Required divisions.--(a) The association |
3 | shall establish two divisions within the organization as |
4 | follows: |
5 | (1) Division I, which division shall consist of public |
6 | schools and nonpublic schools and private schools that do not |
7 | offer scholarships or tuition assistance to students. |
8 | (2) Division II, which division shall consist of nonpublic |
9 | schools and private schools that offer scholarships or tuition |
10 | assistance to students. |
11 | (b) The playoffs and championships of Division I shall be |
12 | held concurrently with the playoffs and championships of |
13 | Division II. |
14 | (c) The association shall revise its policies to implement |
15 | the provisions of this section. |
16 | Section 2. Nothing in this act shall be construed to require |
17 | the Pennsylvania Interscholastic Athletic Association to revise |
18 | current classifications by enrollment and the existing |
19 | classification structure may continue to exist within the |
20 | confines of the requirements for Divisions I and II as specified |
21 | in section 1607-A of the act. |
22 | Section 3. This act shall take effect in 60 days. |
