| |
1 | Itemizing public improvement projects for flood protection and | <-- |

4 | costs; providing for the adoption of specific disaster |
5 | mitigation or assistance projects or flood assistance |
6 | projects, together with their estimated financial costs; |
7 | authorizing the use of interest earnings held by the |
8 | Commonwealth Financing Authority for funding the projects; |
9 | and making appropriations. |
10 | Implementing the provisions of clause (1) of subsection (a) of | <-- |
11 | section 7 of Article VIII of the Constitution of |
12 | Pennsylvania, authorizing the incurring of debt for the |
13 | rehabilitation of areas affected by Hurricane Irene and |
14 | Tropical Storm Lee; imposing duties upon the Governor, the |
15 | Auditor General and the State Treasurer; prescribing the |
16 | procedures for the issuance, sale and payment of general |
17 | obligations bonds, the funding of debt and refunding of |
18 | bonds; exempting said bonds from State and local taxation; |
19 | creating the Disaster Relief Fund and the Disaster Relief |
20 | Redemption Fund; providing for allocation of proceeds; making |

5 | Section 101. Short title. |
6 | This act shall be known and may be cited as the Flood Control |
7 | and Disaster Mitigation Itemization Act of 2012. |

10 | Section 301. Scope. |
11 | This chapter relates to disaster capital budget project |
12 | itemizations in 2012. |
13 | Section 302. Construction of chapter. |
14 | For purposes of this act, the projects itemized in this |
15 | chapter shall be considered public improvement projects under |
16 | the provisions of the act of February 9, 1999 (P.L.1, No.1), |
17 | known as the Capital Facilities Debt Enabling Act, for the |
18 | purposes of the administration and procurement. |

23 | successors or assigns and to be funded as specified in section |

3 | The projects itemized in this chapter shall be funded from a |
4 | portion of existing interest earnings held by the Commonwealth |
5 | Financing Authority established under 64 Pa.C.S. Ch. 15 |

7 | Section 306. Transfer and appropriations. |
8 | Notwithstanding the provisions of 64 Pa.C.S. Ch. 15 Subchs. B |
9 | (relating to structure and powers) and C (relating to bonds), |
10 | interest earnings held by the Commonwealth Financing Authority |
11 | in an amount not exceeding $6,171,000 shall be transferred to |
12 | the Capital Facilities Fund and appropriated to the Department |
13 | of General Services to be used by it exclusively to defray the |
14 | financial cost of the projects specifically itemized in this |
15 | chapter. |
16 | Section 307. Federal funds. |
17 | All moneys received from the Federal Government for the |
18 | projects specifically itemized in this chapter are also hereby |
19 | appropriated for those projects. |
20 | Section 308. Construction. |
21 | (a) Amounts contained in this chapter for any project shall |
22 | not supplant or replace any Federal funds authorized by any |
23 | Federal law or regulation. Funding from this chapter for any |
24 | project is available only to the extent that Federal funds are |
25 | not available for such project. |
26 | (b) Projects which are itemized in this chapter are deemed |
27 | to be flood mitigation projects for purposes of and funding |
28 | under Chapter 5 to the extent that the projects qualify under |
29 | The Robert T. Stafford Disaster Relief and Emergency Assistance |
30 | Act (Public Law 93-288, 88 Stat. 143). |

3 | Section 501. Scope. |
4 | This chapter relates to disaster mitigation and assistance |
5 | projects itemization in 2012. |
6 | Section 502. Definitions. |
7 | The following words and phrases when used in this chapter |
8 | shall have the meanings given to them in this section unless the |
9 | context clearly indicates otherwise: |
10 | "Disaster." The period of time in calendar year 2011 |
11 | relating to Hurricane Irene and Tropical Storm Lee that was the |
12 | subject of a Presidential declaration of an emergency under The |
13 | Robert T. Stafford Disaster Relief and Emergency Assistance Act |
14 | (Public Law 93-288, 88 Stat. 143). |
15 | Section 503. Total authorization. |
16 | The total authorization for disaster mitigation projects or |
17 | public assistance projects as defined in The Robert T. Stafford |
18 | Disaster Relief and Emergency Assistance Act (Public Law 93-288, |
19 | 88 Stat. 143) or as a project qualifying for assistance by the |
20 | United States Army Corps of Engineers and to be financed in part |
21 | with grants limited to the required match for the Federal share |
22 | of the costs made to local political subdivisions or nonprofit |
23 | organizations where applicable as itemized in this chapter is |
24 | $61,791,000. Projects for which no Federal funds are received |
25 | shall not receive funding under this chapter. |

4 | Section 513. Funds. |
5 | The projects itemized in this chapter shall be funded as |
6 | specified in section 516 in an amount not to exceed |
7 | $15,548,000 in the aggregate. |
8 | Section 514. State and local participation levels. |
9 | (a) Public assistance.--The required non-Federal |
10 | contribution of 25% or 20%, as appropriate, necessary to secure |
11 | Federal public assistance funding shall be divided between the |
12 | State and the affected local political subdivision or nonprofit |
13 | organization where applicable. The State share shall not exceed |
14 | 22% of the total cost of the projects. |
15 | (b) Local waiver.--The Commonwealth may reduce the share of |
16 | an affected political subdivision if the tax base of that |
17 | political subdivision was substantially reduced as a direct |
18 | result of Hurricane Irene or Tropical Storm Lee or if payment of |
19 | the local share exceeds 40% of the most recently adopted annual |
20 | budget of the political subdivision. The Commonwealth may |
21 | require the adoption of appropriate flood control or storm water |
22 | management plans as a condition of the waiver if the adoption of |
23 | the plan does not present additional financial hardship. |
24 | Section 515. Federal funds. |
25 | All moneys received from the Federal Government for the |
26 | projects specifically itemized in this chapter are also hereby |
27 | appropriated for those projects. |
28 | Section 516. State funds. |
29 | The State share of funding for projects itemized in this |
30 | chapter shall be funded from a portion of existing interest |

1 | earnings held by the Commonwealth Financing Authority |
2 | established under 64 Pa.C.S. Ch. 15 (relating to Commonwealth |
3 | Financing Authority). |
4 | Section 517. Transfer and appropriation. |

14 | Amounts contained in this chapter for any project shall not |
15 | supplant or replace any Federal funds authorized by any Federal |
16 | law or regulation. Funding from this chapter for any project is |
17 | available only to the extent that Federal funds are not |
18 | available for such project. |
19 | CHAPTER 7 |
20 | MISCELLANEOUS PROVISIONS |
21 | Section 701. Constitutional construction. |
22 | The provisions of this act shall be severable and, if any of |
23 | the provisions of this act shall be held unconstitutional, such |
24 | decisions shall not affect the validity of any of the remaining |
25 | provisions of this act. It is hereby declared as the legislative |
26 | intent that this act would have been adopted had such |
27 | unconstitutional provisions not been included in this act. |
28 | Section 702. Effective date. |
29 | This act shall take effect immediately. |

9 | section 7 of Article VIII of the Constitution of Pennsylvania, |
10 | the Commonwealth is hereby authorized and directed to borrow |
11 | from time to time money not exceeding in the aggregate the sum |
12 | of $150,000,000, not including money borrowed to refund |
13 | outstanding bonds, notes or replacement notes, as may be found |
14 | necessary to carry out the rehabilitation of areas affected by |
15 | Hurricane Irene and Tropical Storm Lee. |
16 | Section 202. General obligation bonds authorized. |
17 | The indebtedness authorized under section 201 shall be |
18 | incurred from time to time and shall be evidenced by one or more |
19 | series of general obligation bonds or notes of the Commonwealth |
20 | in such aggregate principal amount for each series as the |
21 | Governor, the Auditor General and the State Treasurer shall |
22 | determine, but the latest stated maturity date shall not exceed |
23 | 20 years from the date of the bond first issued for each such |
24 | series. |
25 | Section 203. Disposition and use of proceeds. |
26 | (a) Establishment of fund.--The proceeds from the sale of |
27 | bonds and notes, except refunding bonds and replacement notes, |
28 | issued pursuant to the provisions of this act shall be paid to |
29 | the State Treasurer and be held in a separate fund to be |
30 | established and known as the Disaster Relief Fund. |

1 | (b) Dedication of funds.--The moneys in the Disaster Relief |
2 | Fund are hereby specifically dedicated to meeting the costs of |
3 | the rehabilitation of areas affected by Hurricane Irene and |
4 | Tropical Storm Lee, including, but not limited to, projects that |
5 | are defined in or authorized by The Robert T. Stafford Disaster |
6 | Relief and Emergency Assistance Act (Public Law 93-288, 88 Stat. |
7 | 143) and paying the costs and expenses of issuing bonds and |
8 | notes. |
9 | (c) Interest earnings.--Pending their application to the |
10 | purposes authorized, moneys held or deposited by the State |
11 | Treasurer may be invested and reinvested as are other funds in |
12 | the custody of the State Treasurer in the manner provided by |
13 | law. All earnings received from the investment or deposit of |
14 | those funds shall be paid into the State Treasury to the credit |
15 | of the Disaster Relief Fund. |
16 | (d) Allocation of proceeds.--Subject to the total limit of |
17 | $150,000,000, the funds authorized to be borrowed under section |
18 | 201 shall be allocated as follows: |
19 | (1) An amount not to exceed 75% of the funds shall be |
20 | used to provide for the Commonwealth's share of all costs, |
21 | including costs for highways and bridges, flood control and |
22 | disaster mitigation costs provided by the Federal Government |
23 | under The Robert T. Stafford Disaster Relief and Emergency |
24 | Assistance Act. |
25 | (2) (i) At least 25% of the funds shall be used for the |
26 | cost of the following projects pursuant to the disaster |
27 | proclamation: |
28 | (A) Projects for the rehabilitation, |
29 | construction, reconstruction, repair, other than |
30 | normal maintenance, or the replacement of highways |

1 | and bridges, flood control and disaster mitigation |
2 | not funded by the Federal Government or funded by the |
3 | Federal Government at a level insufficient to meet |
4 | current codes and standards. |
5 | (B) Projects for the rehabilitation, |
6 | construction, reconstruction, repair, other than |
7 | normal maintenance, or the replacement of any public |
8 | facility of a political subdivision in counties |
9 | declared as disaster areas that are not funded by the |
10 | Federal Government or are funded by the Federal |
11 | Government at a level insufficient to meet current |
12 | codes and standards. |
13 | (C) Projects for the rehabilitation, |
14 | construction, reconstruction, repair, other than |
15 | normal maintenance, or the replacement of any |
16 | nonprofit facility owned and operated by a nonprofit |
17 | organization in counties declared as disaster areas |
18 | that are not funded by the Federal Government or are |
19 | funded by the Federal Government at a level |
20 | insufficient to meet current codes and standards. |
21 | (ii) If the funding for projects under this |
22 | paragraph is insufficient to provide assistance for all |
23 | eligible projects, the Commonwealth shall prioritize |
24 | projects by considering the following factors: |
25 | (A) The severity of disaster-related damages to |
26 | be rectified by the project. |
27 | (B) Whether the project will improve the health, |
28 | safety and welfare of the affected population. |
29 | (C) The consistency of the project with other |
30 | State and regional resource management and economic |
|
1 | development plans. |
2 | (D) The financial condition of the applicant, |
3 | including revenues, expenses, debt structure, equity |
4 | position and available collateral. |
5 | (E) The economic and financial condition of the |
6 | community to be served, including the tax base, |
7 | annual budget and percentage of low-income and |
8 | moderate-income residents. |
9 | (F) The inability of the applicant to secure |
10 | funding from other sources. |
11 | (iii) No project may be funded under subparagraph |
12 | (i)(A) or (B) unless the Commonwealth determines that |
13 | there was an adequate appeal of the denial of Federal |
14 | funding or of the inadequate level of Federal funding. |
15 | (e) Transfer of unused funds.--Moneys in the Disaster Relief |
16 | Fund not necessary to pay unexpired contracts or to pay |
17 | potential legal obligations shall be transferred by the State |
18 | Treasurer, with the approval of the Governor, to the Disaster |
19 | Relief Redemption Fund and shall be used to pay debt service on |
20 | the existing disaster relief bonds. |
21 | Section 204. Issuance of bonds, interest and maturity. |
22 | (a) Series and issues.--When bonds are issued from time to |
23 | time, the bonds of each issue shall constitute a separate series |
24 | to be designated by the issuing officials or may be combined for |
25 | sale as one series with other general obligation bonds of the |
26 | Commonwealth. Each series of bonds shall bear such rate or rates |
27 | of interest as may be determined by the issuing officials. The |
28 | bonds shall be issued in the denominations and in the forms, |
29 | whether coupon or registered as to both principal and interest, |
30 | and with or without provisions for interchangeability, as the |
|
1 | issuing officials may determine. In case interest coupons are |
2 | attached, they shall contain the facsimile signature of the |
3 | State Treasurer. |
4 | (b) Terms.--Except as otherwise set forth in this act, the |
5 | terms and conditions of issue, redemption and maturity and time |
6 | of payment of interest shall be as the issuing officials shall |
7 | specify. The issuing officials shall provide for the |
8 | amortization of the bonds in substantial and regular amounts |
9 | over the term of the debt. The first retirement of principal |
10 | shall be stated to mature prior to the expiration of a period of |
11 | time equal to one-tenth of the time from the date of the first |
12 | obligation issued to evidence the debt to the date of the |
13 | expiration of the term of the debt. Retirements of principal |
14 | shall be regular and substantial if made in annual or semiannual |
15 | amounts whether by stated serial maturities or by mandatory |
16 | sinking fund retirements computed in accordance with either a |
17 | level annual debt service plan, as nearly as may be, or upon the |
18 | equal annual maturities plan. The issuing officials are hereby |
19 | authorized to carry out the provisions of this act relating to |
20 | the issuance of bonds and shall determine all matters in |
21 | connection with the bonds subject to the provisions of this act. |
22 | (c) Signatures.--All bonds issued under the authority of |
23 | this act shall bear the facsimile signatures of the issuing |
24 | officials and a facsimile of the Great Seal of the Commonwealth |
25 | of Pennsylvania and shall be countersigned by a duly authorized |
26 | officer of a duly authorized loan and transfer agent of the |
27 | Commonwealth. |
28 | Section 205. Direct obligations, exemption from taxation and |
29 | means of payment. |
30 | All bonds issued under this act shall be direct obligations |
|
1 | of the Commonwealth, and the full faith and credit of the |
2 | Commonwealth are hereby pledged for the payment of the interest |
3 | on the bonds as the interest becomes due and the payment of the |
4 | principal of the bonds at maturity. All bonds issued under the |
5 | provisions of this act shall be exempt from taxation for State |
6 | and local purposes, except as provided under Article XXIX of the |
7 | act of March 4, 1971 (P.L.6, No.2), known as the Tax Reform Code |
8 | of 1971. The principal of and interest on the bonds shall be |
9 | payable in lawful money of the United States. |
10 | Section 206. Sale of bonds. |
11 | (a) Requirements.--Whenever bonds are issued under this act, |
12 | they shall be offered for sale at not less than 98% of the |
13 | principal amount of the bonds and accrued interest and shall be |
14 | sold by the issuing officials to the highest and best bidder or |
15 | bidders after public advertisement on such terms and conditions |
16 | and upon such open competitive bidding as the issuing officials |
17 | shall direct. The manner and times of advertising shall be |
18 | prescribed by the issuing officials. |
19 | (b) Private sale.--Any portion of a bond issue so offered |
20 | and not sold or subscribed for may be disposed of by private |
21 | sale by the issuing officials in such manner and at such prices, |
22 | not less than 98% of the principal amount of the bonds and |
23 | accrued interest, as the Governor shall direct. No commission |
24 | may be allowed or paid for the sale of any bonds issued under |
25 | the authority of this act. |
26 | (c) Temporary bonds.--Until permanent bonds can be prepared, |
27 | the issuing officials may in their discretion issue in lieu of |
28 | the permanent bonds, temporary bonds in such form and with such |
29 | privileges as to registration and exchange for permanent bonds |
30 | as may be determined by the issuing officials. |

1 | Section 207. Temporary financing authorization. |
2 | (a) Temporary borrowing.--Pending the issuance of bonds of |
3 | the Commonwealth as authorized, the issuing officials are hereby |
4 | authorized, in accordance with the provisions of this act and on |
5 | the credit of the Commonwealth, to make temporary borrowings, |
6 | through public or private sale, not to exceed three years in |
7 | anticipation to the issue of bonds in order to provide funds in |
8 | such amounts as may from time to time be deemed advisable prior |
9 | to the issue of bonds. In order to provide for and in connection |
10 | with the temporary borrowings, the issuing officials may, in the |
11 | name and on behalf of the Commonwealth, enter into purchase, |
12 | loan or credit agreements or other agreements with banks or |
13 | trust companies or other lending institutions, investment |
14 | banking firms or persons in the United States having power to |
15 | enter into the same, which agreements may contain such |
16 | provisions not inconsistent with this act as may be authorized |
17 | by the issuing officials. |
18 | (b) Evidence of debt.--All temporary borrowings made under |
19 | this section shall be evidenced by notes of the Commonwealth, |
20 | which shall be issued from time to time for amounts not |
21 | exceeding in the aggregate the applicable statutory and |
22 | constitutional debt limitation, in a form and in denominations |
23 | and subject to terms and condition of sale and issue, prepayment |
24 | or redemption and maturity, rate or rates of interest and time |
25 | of payment of interest that the issuing officials authorize and |
26 | direct in accordance with this act. The authorization and |
27 | direction may provide for the subsequent issuance of replacement |
28 | notes to refund outstanding notes or replacement notes, which |
29 | replacement notes shall, upon issuance, evidence the borrowing, |
30 | and may specify other terms and conditions with respect to the |
|
1 | notes and replacement notes authorized for issuance that the |
2 | issuing officials may determine and direct. |
3 | (c) Replacement notes.--When the authorization and direction |
4 | of the issuing officials provide for the issuance of replacement |
5 | notes, the issuing officials may, in the name and on behalf of |
6 | the Commonwealth, issue, enter into or authorize and direct the |
7 | State Treasurer to enter into agreements with any banks, trust |
8 | companies, investment banking firms or other institutions or |
9 | persons in the United States having the power to enter |
10 | agreements: |
11 | (1) To purchase or underwrite an issue or series of |
12 | issues of notes. |
13 | (2) To credit, to enter into purchase, loan or credit |
14 | agreements, to draw moneys pursuant to the agreement on the |
15 | terms and conditions set forth in the agreement and to issue |
16 | notes as evidence of borrowings made under the agreement. |
17 | (3) To appoint an issuing and paying agent or agents |
18 | with respect to notes. |
19 | (4) To do such other acts as may be necessary or |
20 | appropriate to provide for the payment, when due, of the |
21 | interest on and the principal of the notes. |
22 | An agreement may provide for the compensation of any purchasers |
23 | or underwriters of notes or replacement notes by discounting the |
24 | purchase price of the notes or by payment of a fixed fee or |
25 | commission at the time of issuance of the notes, and all other |
26 | costs and expenses, including fees for agreements related to the |
27 | notes, issuing and paying agent costs and costs and expenses of |
28 | issuance, may be paid from the proceeds of the notes. |
29 | (d) Duties of State Treasurer.--When the authorization and |
30 | direction of the issuing officials provide for the issuance of |
|
1 | replacement notes, the State Treasurer shall, at or prior to the |
2 | time of delivery of these notes or replacement notes, determine |
3 | the principal amounts, dates of issue, interest rate or rates or |
4 | procedures for establishing interest rates from time to time, |
5 | rates of discount, denominations and all other terms and |
6 | conditions relating to the issuance and shall perform all acts |
7 | and things necessary to pay or cause to be paid, when due, all |
8 | principal of and interest on the notes being refunded by |
9 | replacement notes and to assure that the replacement notes may |
10 | draw upon any moneys available for that purpose pursuant to any |
11 | purchase, loan or credit agreements established with respect to |
12 | the replacement notes, all subject to the authorization and |
13 | direction of the issuing officials. |
14 | (e) Retirement of outstanding notes.--Outstanding notes |
15 | evidencing the borrowings may be funded and retired by the |
16 | issuance and sale of the bonds of the Commonwealth as authorized |
17 | under this act. The refunding bonds must be issued and sold not |
18 | later than a date three years after the date of issuance of the |
19 | first notes evidencing the borrowings to the extent that payment |
20 | of the notes has not otherwise been made or provided for by |
21 | sources other than proceeds of replacement notes. |
22 | (f) Disposition of proceeds.--The proceeds of all the |
23 | temporary borrowing shall be paid to the State Treasurer to be |
24 | held and disposed of in accordance with this act. |
25 | Section 208. Disaster Relief Redemption Fund. |
26 | (a) Establishment.--All bonds issued under the authority of |
27 | this act shall be paid at maturity and all interest due from |
28 | time to time on the bonds and on all notes issued under this act |
29 | shall be paid from the Disaster Relief Redemption Fund. The |
30 | General Assembly shall appropriate annually the moneys necessary |
|
1 | to pay the interest on the bonds and notes and the principal of |
2 | the bonds and notes at maturity for which other provision is not |
3 | made. All moneys so appropriated shall be paid into the Disaster |
4 | Relief Redemption Fund by the State Treasurer. All moneys so |
5 | received prior to the date for disbursement of the moneys shall |
6 | be invested by the State Treasurer pending disbursement in such |
7 | securities as are provided by law for the investment of surplus |
8 | moneys of the Commonwealth. |
9 | (b) Use of fund.--The investment of the moneys and the |
10 | accumulations on the moneys in the Disaster Relief Redemption |
11 | Fund shall be devoted to and be used exclusively for the payment |
12 | of the interest accruing on the bonds and notes and for the |
13 | redemption of the bonds and notes at maturity or upon the |
14 | redemption date, if called for prior redemption. The State |
15 | Treasurer, with the approval of the Governor, is authorized at |
16 | any time to use any of those funds for the purchase and |
17 | retirement of all or any part of the bonds issued under this |
18 | act. No purchase may be made that will reduce the moneys in the |
19 | Disaster Relief Redemption Fund below the amount necessary to |
20 | pay all principal and interest still to become due in the fiscal |
21 | year of the purchase. In the event that all or any part of the |
22 | bonds shall be purchased by the Commonwealth, they shall be |
23 | canceled and returned to the State Treasurer as canceled and |
24 | paid bonds, and thereafter all payments of interest on the bonds |
25 | shall cease and the canceled bonds and coupons shall be |
26 | destroyed as promptly as possible after cancellation but not |
27 | later than two years after cancellation. A certificate |
28 | evidencing the destruction of the canceled bonds, notes and |
29 | coupons shall be provided by the loan and transfer agent to the |
30 | issuing officials. All canceled bonds, notes and coupons shall |
|
1 | be so mutilated as to make the canceled bonds, notes and coupons |
2 | nonnegotiable. |
3 | Section 209. Refunding bonds. |
4 | The issuing officials may provide by resolution for the |
5 | issuance of refunding bonds for the purpose of refunding any |
6 | debt issued under this act and then outstanding, either by |
7 | voluntary exchange with the holders of the outstanding debt or |
8 | may provide funds to redeem and retire the outstanding debt with |
9 | accrued interest, any premium payable thereon and the costs of |
10 | issuance and retirement of the debt at maturity or at any call |
11 | date. The issuance of the refunding bonds, the maturities and |
12 | other details of the refunding bonds, the rights of the holders |
13 | of the refunding bonds and the duties of the issuing officials |
14 | in respect to the refunding bonds shall be governed by the |
15 | provisions of this section insofar as they may be applicable. |
16 | Refunding bonds that are not subject to the aggregate limitation |
17 | of $150,000,000 of debt to be issued under this act may be |
18 | issued by the issuing officials to refund debt originally issued |
19 | or to refund bonds previously issued for refunding purposes. |
20 | Section 210. Reporting requirements. |
21 | The State Treasurer shall determine and report to the |
22 | Secretary of the Budget by November of each year the amount of |
23 | money necessary for the payment of interest on outstanding |
24 | obligations and the principal of the obligations, if any, for |
25 | the following fiscal year and the times and amounts of those |
26 | payments. |
27 | Section 211. Registration of bonds. |
28 | The Auditor General shall prepare the necessary registry |
29 | books to be kept in the office of the duly authorized loan and |
30 | transfer agent of the Commonwealth for the registration of any |
|
1 | bonds of the Commonwealth at the request of the owner of the |
2 | bonds according to the terms and conditions of issue specified |
3 | by the issuing officials. All bonds that are issued without |
4 | interest coupons attached shall be registered in the registry |
5 | books kept by the duly authorized loan and transfer agent of the |
6 | Commonwealth. |
7 | Section 212. Voting requirements. |
8 | Whenever in this act an action is to be taken or decision |
9 | made by the issuing officials, and the three officers shall not |
10 | be able to agree unanimously, the action or decision of the |
11 | Governor and either the Auditor General or the State Treasurer |
12 | shall be binding and final. |
13 | Section 213. Appropriation. |
14 | (a) Appropriation to Governor.--The net proceeds, less the |
15 | costs and expenses of issuing the obligations, of the sale of |
16 | the $150,000,000 of obligations authorized under this act are |
17 | appropriated from the Disaster Relief Fund to the Governor for |
18 | allocation by the Secretary of the Budget as provided under |
19 | section 203(d) to State agencies for projects authorized under |
20 | this act. |
21 | (b) Appropriation to State Treasurer.--There is appropriated |
22 | to the State Treasurer from the Disaster Relief Fund as much |
23 | money as may be necessary for all costs and expenses in |
24 | connection with the issue of and sale and registration of the |
25 | bonds and notes in connection with this act and the payment of |
26 | interest arbitrage rebates on proceeds of the bonds and notes. |

3 | Whenever as determined by the Commonwealth or a municipality |
4 | that the full estimated financial costs of the projects itemized |
5 | in sections 603 through 614 are not necessary for the proper |
6 | design, acquisition or construction of such projects, the excess |
7 | funds no longer required may be allocated by the Commonwealth or |
8 | a municipality to increase the estimated costs of any one or |
9 | more of the projects specifically itemized in this act. |
10 | Section 619. Projects not itemized herein. |
11 | Nothing in this act may prohibit a flood control, hazard |
12 | mitigation or assistance project with an estimated financial |
13 | cost exceeding $100,000, not itemized herein, or projects that |
14 | do not exceed $100,000 from being financed from debt incurred |
15 | under Chapter 2. The Department of Environmental Protection |
16 | shall certify that a flood control, disaster mitigation or |
17 | assistance project not itemized herein has an estimated |
18 | financial cost that exceeds $100,000 to be eligible for |
19 | financing from debt incurred under Chapter 2. |
