AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

Pennsylvania Consolidated Statutes, further providing for

3

exceptions to governmental immunity.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 8542(b) introductory paragraph of Title

7

42 of the Pennsylvania Consolidated Statutes is amended and the

8

section is amended by adding a subsection to read:

§ 8542.  Exceptions to governmental immunity.

(b)  Acts which may impose liability.--[The] Except as set

12

forth in subsection (b.1), the following acts by a local agency

13

or any of its employees may result in the imposition of

14

liability on a local agency:

(b.1)  No liability shall be imposed on a county or county

17

tax claim bureau for an act set forth in subsection (b) as a

18

result of a county or a county tax claim bureau having acquired

legal or equitable title or possession, care, custody or control

2

of property in accordance with:

3

(1)  the act of May 16, 1923 (P.L.207, No.153), referred

4

to as the Municipal Claim and Tax Lien Law;

5

(2)  the act of July 7, 1947 (P.L.1368, No.542), known as

6

the Real Estate Tax Sale Law; or

7

(3)  any other statute authorizing a tax sale or

8

treasurer's sale on tax liens.

Section 2.  The addition of section 8542(b.1) shall not apply

11

to a cause of action which arose prior to the effective date of

12

this section.

Section 3.  This act shall take effect in 60 days.
