AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," in preliminary provisions, providing

6

for limitation on increases of salaries of school employees.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  The act of March 10, 1949 (P.L.30, No.14), known

10

as the Public School Code of 1949, is amended by adding a

11

section to read:

Section 118.  Limitation on Increases of Salaries of School

13

Employes.--(a)  During the course of a calendar year, any

14

increase in salary for a school employe shall be limited to a

15

percentage increase not in excess of the index.

16

(b)  A school employe contract or collective bargaining

17

agreement entered into by a school entity shall:

18

(1)  Limit the percentage of a salary increase from the prior

19

year to the current year and from one year to the next year

20

under the term of the contract to not more than the index or a

negotiated salary increase, whichever represents a lower

2

percentage increase.

(2)  State that any future salary increase is subject to the

4

provisions of this section.

(c)  This section shall apply to a school employe contract or

6

collective bargaining agreement entered into by a school entity

7

after the effective date of this section.

(d)  For purposes of this section:

9

"Index" shall have the same meaning given to it under section

10

302 of the act of June 27, 2006 (1st Sp. Sess., P.L.1873, No.1),

11

known as the Taxpayer Relief Act.

"School employe" shall include any professional employe,

13

substitute and temporary professional employe as defined in

14

section 1101 and all other persons employed by a school entity.

15

Section 2.  This act shall take effect in 60 days.
