| AN ACT |
| |
1 | Amending the act of June 2, 1959 (P.L.454, No.86), entitled, "An |
2 | act permitting the recording of leases, subleases and |
3 | agreements to lease or sublease; permitting the recording of |
4 | memoranda thereof; prescribing the minimum contents of such |
5 | memoranda; prescribing the effect of recording such |
6 | instruments, including provisions thereof for the purchase of |
7 | or refusal on the demised premises; and specifying that the |
8 | recording of such a memorandum shall be a sufficient |
9 | recording of the full lease, sublease, or agreement in |
10 | connection with the assignment or mortgaging of the lessee's |
11 | interest therein," further providing for indexing of leases, |
12 | subleases, agreements and memoranda. |
13 | The General Assembly of the Commonwealth of Pennsylvania |
14 | hereby enacts as follows: |
15 | Section 1. Section 3 of the act of June 2, 1959 (P.L.454, |
16 | No.86), entitled, "An act permitting the recording of leases, |
17 | subleases and agreements to lease or sublease; permitting the |
18 | recording of memoranda thereof; prescribing the minimum contents |
19 | of such memoranda; prescribing the effect of recording such |
20 | instruments, including provisions thereof for the purchase of or |
21 | refusal on the demised premises; and specifying that the |
22 | recording of such a memorandum shall be a sufficient recording |

1 | of the full lease, sublease, or agreement in connection with the |
2 | assignment or mortgaging of the lessee's interest therein," is |
3 | amended to read: |
4 | Section 3. Any such lease, sublease, agreement or |
5 | memorandum, so recorded, shall be indexed by the recording |
6 | officer in the grantor index against the lessor therein named |
7 | and in the grantee index against the lessee therein named. A gas |
8 | lease, sublease, agreement or memorandum shall also be indexed |
9 | by property address. |
10 | Section 2. This act shall take effect in 60 days. |
