SENATOR GORDNER, LABOR AND INDUSTRY, IN SENATE, AS AMENDED, JUNE 29, 2011   

AN ACT

Amending the act of July 2, 1984 (P.L.561, No.112), entitled "An

act establishing the Pennsylvania Conservation Corps; and

making an appropriation," further providing for the

definitions of "department" and "secretary"; and transferring

the administration of the Pennsylvania Conservation Corps

from the Department of Labor and Industry to the Department

of Conservation and Natural Resources; and making an

appropriation.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  The definitions of "department" and "secretary"

in section 2 of the act of July 2, 1984 (P.L.561, No.112), known

as the Pennsylvania Conservation Corps Act, amended June 25,

1997 (P.L.339, No.38), are amended to read:

Section 2.  Definitions.

The following words and phrases when used in this act shall

have the meanings given to them in this section unless the

context clearly indicates otherwise:

"Department."  The Department of [Labor and Industry] 

Conservation and Natural Resources.

"Secretary."  The Secretary of [Labor and Industry] 

Conservation and Natural Resources.

Section 2.  Section 3 of the act, amended July 2, 1993

(P.L.350, No.49), is amended to read:

Section 3.  Pennsylvania Conservation Corps created.

There is hereby created within the Department of [Labor and

Industry] Conservation and Natural Resources the Pennsylvania

Conservation Corps.

Section 3.  The act is amended by adding a section to read:

Section 12.2.  Transfers.

There are transferred from the Department of Labor and

Industry to the Department of Conservation and Natural Resources

all of the following:

(1)  The property, supplies, equipment and records being

used in the administration of this act.

(2)  The personnel employed in the administration of this

act.

(3)  The unexpended balances of appropriations,

allocations and other funds available under this act.

(4)  The rights and obligations of contracts entered into

under this act.

Section 4.  This act shall take effect  July 1, 2012.

Section 4.  The sum of $4,000,000 is hereby appropriated from

the Oil and Gas Lease Fund established under the act of December

15, 1955 (P.L.865, No.256), entitled "An act requiring rents and

royalties from oil and gas leases of Commonwealth land to be

placed in a special fund to be used for conservation,

recreation, dams, and flood control; authorizing the Secretary

of Forests and Waters to determine the need for and location of

such projects and to acquire the necessary land," to the

Department of Labor and Industry for the purpose of funding the

Pennsylvania Conservation Corps for the fiscal period beginning

July 1, 2011, to June 30, 2012.

Section 5.  This act shall take effect as follows:

(1)  Section 4 of this act shall take effect July 1,

2011.

(2)  The remainder of this act shall take effect July 1,

2012.
