AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

Statutes, in snowmobiles and all-terrain vehicles, further

providing for operation by persons under age 16.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  Section 7725 of Title 75 of the Pennsylvania

Consolidated Statutes is amended by adding a subsection to read:

§ 7725.  Operation by persons under age sixteen.

(h.1)  Exemption from liability.--The owner of land who

authorizes the owner's property to be used for the purpose of an

approved snowmobile and ATV information, safety education and

training program as provided in subsection (h) shall not be held

civilly liable for any injury or death to persons or damage to

property that may occur during the course of instruction or

training, except for willful or malicious failure to warn

against a dangerous condition, use, structure or activity.

Section 2.  This act shall take effect in 60 days.
