AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

Pennsylvania Consolidated Statutes, in budget and finance,

3

further providing for Commonwealth portion of fines.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 3571(b)(2) of Title 42 of the

7

Pennsylvania Consolidated Statutes is amended and the subsection

8

is amended by adding a paragraph to read:

§ 3571.  Commonwealth portion of fines, etc.

(b)  Vehicle offenses.--

(2)  Except as provided in [paragraph (4)] paragraphs (4)

14

and (5), when prosecution under any other provision of Title

15

75 (relating to vehicles) is the result of State Police

16

action, all of the following apply:

17

(i)  All fines, forfeited recognizances and other

18

forfeitures imposed, lost or forfeited shall be payable

to the Commonwealth, for credit to the Motor License

2

Fund. One-half of the revenue shall be paid to

3

municipalities as designated in subparagraph (ii) in the

4

same ratio provided in section 4 of the act of June 1,

5

1956 (1955 P.L.1944, No.655), [relating to partial

6

allocation of liquid fuels and fuel use tax proceeds.] 

7

referred to as the Liquid Fuels Tax Municipal Allocation

8

Law.

(ii)  Distribution of revenue is as follows:

10

(A)  Only a municipality that has a population of

11

not more than 3,000 or that provides at least 40

12

hours per week of local police services through a

13

municipal police department, participation in a

14

regional police department or contracts with other

15

municipal or regional police for police services may

16

receive revenue under subparagraph (i).

17

(B)  Revenue that is not paid to municipalities

18

under clause (A) shall be transferred to the

19

Pennsylvania State Police for cadet classes.

(5)  When prosecution under any other provision of Title

22

75 is the result of State Police action on an interstate

23

highway, as defined in 75 Pa.C.S. § 102 (relating to

24

definitions), all fines, forfeited recognizances and other

25

forfeitures imposed, lost or forfeited shall be payable to

26

the Commonwealth, for credit to the Motor License Fund.

Section 2.  This act shall take effect in 60 days.
