| AN ACT |
| |
1 | Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An |
2 | act to consolidate, editorially revise, and codify the public |
3 | welfare laws of the Commonwealth," providing for electronic |
4 | prior approval for Medicaid. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. The act of June 13, 1967 (P.L.31, No.21), known |
8 | as the Public Welfare Code, is amended by adding a section to |
9 | read: |
10 | Section 450. Electronic Prior Approval Process.--The Medical |
11 | Assistance Fee for Service Program shall have an electronic |
12 | prior approval process in place 60 one hundred twenty days after | <-- |
13 | the effective date of this section for use by physicians to |
14 | secure approval of all any preferred and nonpreferred drugs | <-- |
15 | requiring prior approval. Nonpreferred Preferred and | <-- |
16 | nonpreferred drugs prescribed by Pennsylvania licensed |
17 | physicians specializing in the field of psychiatry shall be |

1 | exempt from prior authorization requirements. The department |
2 | shall draft guidelines to update lists and processes on a |
3 | regular basis in order to best meet the needs of the citizens of |
4 | this Commonwealth. |
5 | Section 2. This act shall take effect in 180 days. |
