| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, in particular rights and |
3 | immunities, further providing for nonmedical good Samaritan |
4 | civil immunity. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 8332(b)(2) of Title 42 of the |
8 | Pennsylvania Consolidated Statutes is amended to read: |
9 | § 8332. Nonmedical good Samaritan civil immunity. |

11 | (b) Exceptions.-- |

13 | [(2) In order for any person to receive the benefit of |
14 | the exemption from civil liability provided for in subsection |
15 | (a), he shall be, at the time of rendering the emergency |
16 | care, first aid or rescue or moving the person receiving |
17 | emergency care, first aid or rescue to a hospital or other |

1 | place of medical care, the holder of a current certificate |
2 | evidencing the successful completion of a course in first |
3 | aid, advanced life saving or basic life support sponsored by |
4 | the American National Red Cross or the American Heart |
5 | Association or an equivalent course of instruction approved |
6 | by the Department of Health in consultation with a technical |
7 | committee of the Pennsylvania Emergency Health Services |
8 | Council and must be performing techniques and employing |
9 | procedures consistent with the nature and level of the |
10 | training for which the certificate has been issued.] |
11 | Section 2. This act shall take effect in 60 days. |
