| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, further providing for |
3 | surcharge. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 3733.1(a) and (c) of Title 42 of the |
7 | Pennsylvania Consolidated Statutes are amended by adding |
8 | paragraphs to read: |
9 | § 3733.1. Surcharge. |
10 | (a) Imposition of surcharge.--In addition to each fee |
11 | imposed under section 3733(a.1) (relating to deposits into |
12 | account), except as set forth in subsection (b), the following |
13 | apply: |

15 | (3) Upon expiration of the surcharge under paragraph |
16 | (1), a permanent surcharge of $11.25 shall be charged and |
17 | collected. |

19 | (c) Allocation and appropriation.-- |

2 | (3) The surcharge under subsection (a)(3) shall be |
3 | allocated as follows: |
4 | (i) One dollar shall be deposited into the Access to |
5 | Justice Account. |
6 | (ii) Two dollars shall be deposited into the Public |
7 | Integrity Commission Fund established in 65 Pa.C.S. § |
8 | 1109.1(b). |
9 | (iii) The remainder of money shall be deposited into |
10 | a separate reserve account within the Judicial Computer |
11 | System Augmentation Account. Notwithstanding section 3732 |
12 | (relating to utilization of funds in account), money |
13 | deposited under this subparagraph is hereby appropriated |
14 | to the Supreme Court, upon compliance with Article XV of |
15 | the Fiscal Code, for the operation of the judicial |
16 | department. |
17 | Section 2. This act shall take effect in 60 days. |
