AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, further providing for grounds for refusing

3

registration.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 1306 of Title 75 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 1306.  Grounds for refusing registration.

9

The department shall refuse registration, renewal or transfer

10

of registration when any of the following circumstances exists:

11

(1)  The applicant is not entitled to registration under

12

the provisions of this chapter.

13

(2)  The applicant has at registration or titling

14

neglected or refused to furnish the department with the

15

information required on the appropriate official form, or any

16

reasonable additional information required by the department.

17

(3)  The department has reasonable grounds to believe

that the application contains false or fraudulent

2

information, or that the vehicle is stolen, which fact the

3

department shall ascertain by reference to the stolen vehicle

4

file required to be maintained under section 7114 (relating

5

to records of stolen vehicles), or that the granting of

6

registration would constitute a fraud against the rightful

7

owner or other person having a valid lien upon the vehicle.

8

(4)  The fees required by law have not been paid.

9

(5)  The vehicle is not constructed or equipped as

10

required by this title.

11

(6)  The registration of the vehicle stands suspended for

12

any reason as provided for in this title.

13

(7)  Self-certification of financial responsibility, as

14

required under section 1305(d) (relating to application for

15

registration), is not filed with the registration

16

application.

(10)  An out-of-service order has been issued for the

18

vehicle, the owner or operator by the department or the

19

United States Department of Transportation.

20

(11)  Self-certification of current safety inspection for

21

a motor carrier vehicle, as required by section 1309

22

(relating to renewal of registration), is not filed with the

23

application for renewal of registration.

24

(12)  The applicant is delinquent in the payment of any

25

fines, including surcharges, penalties and other costs or

26

fees imposed by a court of this Commonwealth for any

27

violation of law. The department may register, renew or

28

transfer a registration subject to this paragraph upon

29

receipt of written notice, or notification by electronic

30

mail, from a court that the applicant has paid all fines,

including any surcharges, penalties and costs associated with

2

the violations.

Section 2.  This act shall take effect immediately.
