AN ACT

Amending the act of June 26, 2001 (P.L.755, No.77), entitled "An

2

act establishing a special fund and account for money

3

received by the Commonwealth from the Master Settlement

4

Agreement with tobacco manufacturers; providing for home and

5

community-based care, for tobacco use prevention and

6

cessation efforts, for Commonwealth universal research

7

enhancement, for hospital uncompensated care, for health

8

investment insurance, for medical assistance for workers with

9

disabilities, for regional biotechnology research centers,

10

for the HealthLink Program, for community-based health care

11

assistance programs, for PACE reinstatement and PACENET

12

expansion, for medical education loan assistance and for

13

percentage allocation and appropriation of moneys," further

14

providing for adult basic coverage insurance program.

The General Assembly of the Commonwealth of Pennsylvania

16

hereby enacts as follows:

Section 1.  Section 1303 of the act of June 26, 2001

18

(P.L.755, No.77), known as the Tobacco Settlement Act, is

19

amended by adding a subsection to read:

Section 1303.  Adult basic coverage insurance program.

(b.1)  Continuation of eligibility.--An eligible adult shall

2

not be deemed ineligible when, following a determination that he

3

or she is eligible for the adult basic coverage insurance

4

program but has been placed on the waiting list for coverage in

5

accordance with subsection (d), he or she has purchased an

6

individual policy or a limited benefit plan. When funding

7

becomes available to offer enrollment in the adult basic

8

insurance program to the person, upon satisfaction of all

9

eligibility requirements, and if enrolled in an individual

10

policy or a limited benefit plan, the person may immediately

11

enroll in the adult basic insurance program, and the initial

12

date of coverage will coincide with the end date of the

13

individual policy or limited benefit plan previously purchased.

Section 2.  This act shall take effect in 60 days.
