| AN ACT |
| |
1 | Amending Title 62 (Procurement) of the Pennsylvania Consolidated |
2 | Statutes, in small and disadvantaged businesses, providing |
3 | for mentor-protégé program. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 62 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 2109. Mentor-protégé program. |
9 | (a) Establishment and purpose of program.-- |
10 | (1) The department shall establish a mentor-protégé |
11 | program to assist disadvantaged businesses in enhancing their |
12 | capabilities to compete for and perform prime contracts and |
13 | subcontracts awarded by a Commonwealth agency. |
14 | (2) The purpose of the mentor-protégé program is to |
15 | foster long-term business relationships between disadvantaged |
16 | businesses and prime contractors in order to facilitate their |
17 | growth and development and increase their prime contracting |
18 | and subcontracting opportunities with Commonwealth agencies. |

1 | (b) General rule.--A prime contractor that is approved as a |
2 | mentor by the department may enter into a written agreement with |
3 | a disadvantaged business to provide developmental assistance to |
4 | enhance the disadvantaged business contracting and |
5 | subcontracting capabilities. Developmental assistance provided |
6 | by a mentor prime contractor to its protégé disadvantaged |
7 | business may include, but not be limited to, the following: |
8 | (1) Management assistance, including financial |
9 | management, organizational management, business management |
10 | and planning and business development. |
11 | (2) Technical assistance. |
12 | (3) Financial assistance. |
13 | (4) Temporary employee assistance. |
14 | (5) Use of facilities, equipment or property without |
15 | charge. |
16 | (6) Any other type of developmental assistance as |
17 | approved by the department. |
18 | (c) Factor to be considered.--Notwithstanding any other |
19 | provision of this title to the contrary, the mentor-protégé |
20 | arrangement between a prime contractor and a disadvantaged |
21 | business whereby the disadvantaged business serves as a joint |
22 | venture partner or subcontractor to the prime contractor shall |
23 | be an important factor to be considered or weighed by a |
24 | Commonwealth agency in awarding a contract under sections 513 |
25 | (relating to competitive sealed proposals), 517 (relating to |
26 | multiple awards), 518 (relating to competitive selection |
27 | procedures for certain services) and 519 (relating to selection |
28 | procedure for insurance and notary bonds). |
29 | (d) Guidelines.--The department shall adopt and publish |
30 | guidelines to enforce and carry out the requirements of this |

1 | section. The guidelines shall be published in the Pennsylvania |
2 | Bulletin and shall include, but may not be limited to, the |
3 | following: |
4 | (1) Selection criteria for mentor and protégé |
5 | businesses. |
6 | (2) An application process, including an application |
7 | form to be used by prime contractors seeking to participate |
8 | in the mentor-protégé program and a time frame for review. |
9 | (3) Criteria for measuring program impact and success. |
10 | (4) The required contents of a mentor-protégé written |
11 | agreement. A written agreement shall specify the type of |
12 | developmental assistance that will be provided by the mentor |
13 | to the protégé disadvantaged business. |
14 | Section 2. This act shall take effect immediately. |
