AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, further providing for learners' permits.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Section 1505(d) and (e) of Title 75 of the

Section 1.  Section 1505(e) of Title 75 of the Pennsylvania

Consolidated Statutes, amended October 25, 2011 (P.L.334,

No.81), is amended to read:

§ 1505.  Learners' permits.

11

(d)  Duration of permit.--A learner's permit shall be valid

<--

13

for a period of one year after date of issue, or until the

14

holder of the permit has failed the examination as authorized in

15

section 1508 (relating to examination of applicant for driver's

16

license) three times within the one-year period. A motorcycle

learner's permit shall not be renewable after one year. A person

2

may reapply for a motorcycle learner's permit no more frequently

3

than three times in a ten-year period.

(e)  Authorization to test for driver's license and junior

5

driver's license.--A person with a learner's permit is

6

authorized to take the examination for a regular or junior

7

driver's license for the class of vehicle for which a permit is

8

held. Before a person under the age of 18 years may take the

9

examination for a junior driver's license, including a Class M

10

license to operate a motorcycle, the minor must:

11

(1)  Have held a learner's permit for that class of

12

vehicle for a period of six months.

13

(2)  Present to the department a certification form

signed by the father, mother, guardian, person in loco

15

parentis or spouse of a married minor stating that the minor

16

applicant has completed 50 hours of practical driving

17

experience accompanied as required under subsection (b).

Submission of a certification shall not subject the parent,

19

guardian, person in loco parentis or spouse of a married

20

minor to any liability based upon the certification.

(2)  Present to the department a certification form

signed by the father, mother, guardian, person in loco

23

parentis or spouse of a married minor stating that the minor

24

applicant has completed 65 hours of practical driving

25

experience, including no less than ten hours of nighttime

26

driving and five hours of inclement weather driving, 

27

accompanied as required under subsection (b). Submission of a

28

certification shall not subject the parent, guardian, person

29

in loco parentis or spouse of a married minor to any

30

liability based upon the certification.

(3)  Have the certification form completed when the minor

2

is ready for the licensing examination. The certification

3

form shall be developed by the department and will be

4

provided by the department when the original application for

5

a learner's permit is processed. The department will make

6

this form readily available through the mail or electronic

7

means.

(4)  Complete the department-approved motorcycle safety

9

course as a requirement for obtaining a Class M junior

10

driver's license.

Section 2.  This act shall take effect in 60 days.
