AN ACT

  

1

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," further providing for approved

6

reimbursable rental for certain leases and approved

7

reimbursable sinking fund charges on indebtedness.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

10

Section 1.  Section 2574(b)(1) and (c)(1) of the act of March

11

10, 1949 (P.L.30, No.14), known as the Public School Code of

12

1949, added March 22, 1956 (1955 P.L.1315, No.417), are amended

13

and the section is amended by adding a subsection to read:

14

Section 2574.  Approved Reimbursable Rental for Leases

15

Hereafter Approved and Approved Reimbursable Sinking Fund

16

Charges on Indebtedness.--* * *

(b)  For new school buildings the approved building

18

construction cost shall be the lesser of

19

(1)  The cost of constructing the school buildings including

20

the cost of essential fixtures and equipment and the cost of

employing or contracting with a construction manager, clerk-of-

2

the-works or other construction administrator to provide

3

professional construction management services but excluding

4

architect's fees in excess of six per cent (6%) of the contract

5

price, or

(c)  For additions [or], alterations or improvements,

8

including, but not limited to, capital improvements related to

9

school safety to existing buildings, approved building

10

construction cost shall be the lesser of

11

(1)  The cost of constructing the additions [or], alterations

12

or improvements, including, but not limited to, capital

13

improvements related to school safety, including the cost of

14

essential fixtures and equipment and the cost of employing or

15

contracting with a construction manager, clerk-of-the-works or

16

other construction administrator to provide professional

17

construction management services but excluding architect's fees

18

in excess of six per cent (6%) of the contract price, or

19

(g)  For purposes of this section, "professional construction

21

management services" shall include:

22

(1)  Services provided in the planning and preconstruction

23

phases of a construction project including, but not limited to,

24

advising, assisting and making recommendations to the school

25

district on all aspects of planning for project construction;

26

reviewing all plans and specifications as they are being

27

developed and making recommendations with respect to

28

construction feasibility, availability of material and labor,

29

time requirements for procurement and construction and projected

30

costs; analyzing the bids received; and preparing and

maintaining a progress schedule during the design phase of the

2

project; and

3

(2)  Services provided in the construction phase of the

4

project including, but not limited to, acting as the district's

5

representative in managing the construction process;

6

establishing procedures for coordinating among the school

7

district, architect or engineer and contractors with respect to

8

all aspects of the project and implementing those procedures;

9

maintaining job site records and making appropriate progress

10

reports; making recommendations and processing requests for

11

changes in the work and maintaining records of change orders;

12

ensuring orderly progress of the work; developing and monitoring

13

a project progress schedule; coordinating and expediting the

14

work of all contractors and providing periodic status reports to

15

the school district; and conducting meetings to review costs.

16

Section 2.  This act shall take effect in 60 days.
