AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

Consolidated Statutes, further providing for the offense of

3

invasion of privacy.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 7507.1(b) of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended, subsection (e) is amended by

8

adding a definition and the section is amended by adding a

9

subsection to read:

§ 7507.1.  Invasion of privacy.

11

(b)  Grading.--Invasion of privacy is a misdemeanor of the

13

second degree if there is more than one violation or if the

14

victim is a minor. Otherwise, a violation of this section is a

15

misdemeanor of the third degree.

(b.1)  Mistake as to age.--It is no defense to prosecution

under this section that the defendant did not know the age of

2

the child. Neither a misrepresentation of age by the child nor a

3

bona fide belief that the person is over the specified age shall

4

be a defense.

(e)  Definitions.--As used in this section, the following

7

words and phrases shall have the meanings given to them in this

8

subsection:

"Minor."  An individual under 18 years of age.

Section 2.  This act shall take effect in 60 days.
