AN ACT

Amending Title 4 (Amusements) of the Pennsylvania Consolidated

2

Statutes, further providing for general and specific powers;

3

and providing for child endangerment protection.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 1202(b) of Title 4 of the Pennsylvania

7

Consolidated Statutes is amended by adding a paragraph to read:

8

§ 1202.  General and specific powers.

9

(b)  Specific powers.--The board shall have the specific

11

power and duty:

(35)  To levy fines against a licensed entity or licensed

14

facility or any affiliate, intermediary, subsidiary or

15

holding company of a licensed entity or licensed facility for

16

two or more violations in a one-year period of individuals

17

leaving a child under 14 years of age unattended in the

vehicle on property that is owned, leased or controlled by a

2

licensed facility or an affiliate, intermediary, subsidiary

3

or holding company of a licensed entity or licensed facility.

Section 2.  Title 4 is amended by adding a section to read:

5

§ 1509.2.  Child endangerment protection.

6

(a)  Warning.--Each slot machine licensee shall provide a

7

warning to all persons regarding the violations of leaving a

8

child unattended in a vehicle in its parking area. Each licensee

9

shall conspicuously post the following statement:

10

Any person who leaves a child unattended in a vehicle on this

11

property while visiting the casino is subject to criminal

12

penalties and will be banned from casinos in this

13

Commonwealth.

14

The statement shall be posted in clear view in the parking

15

areas, at each entrance and in other appropriate public areas of

16

the licensed facility as determined by the slot machine

17

licensee.

(b)  Fine.--A slot machine licensee that fails to post the

19

signs in accordance with subsection (a) shall be assessed a fine

20

of $1,000 a day for each day the minimum number of signs is not

21

posted.

22

(c)  Definition.--As used in this section, the term "parking

23

area" means all parcels of land and improvements owned by the

24

slot machine licensee or its affiliate, intermediary, subsidiary

25

or holding company that are contiguous with or adjoined directly

26

to the licensed facility where vehicles park.

Section 3.  This act shall take effect in 60 days.
