AN ACT

Establishing the Youth Job Creation Program and continuing

2

federally funded subsidized adult employment programs.

3

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Short title.

6

This act shall be known and may be cited as the Youth Job

7

Creation Program Act.

8

Section 2.  Definitions.

9

The following words and phrases when used in this act shall

10

have the meanings given to them in this section unless the

11

context clearly indicates otherwise:

"Community-based agency."  A private, nonprofit organization

13

that is representative of a community or a significant segment

14

of a community that is engaged in meeting human, educational or

15

environmental community needs. The term shall include community

16

development corporations, neighborhood groups and organizations,

17

union-related organizations, employer-related nonprofit

organizations, organizations operating career intern or literacy

2

programs, educational or religious institutions and other

3

nonprofit organizations.

"Department."  The Department of Labor and Industry of the

5

Commonwealth.

6

"Program."  The Youth Job Creation Program established under

7

section 3.

8

"Qualified youth."  An individual between 16 and 21 years of

9

age.

10

"TANF."  The Temporary Assistance for Needy Families program

11

under the Social Security Act (49 Stat. 620, 42 U.S.C. § 301 et

12

seq.).

Section 3.  Youth Job Creation Program.

14

(a)  Establishment.--The Youth Job Creation Program is

15

established within the department to provide grants to

16

community-based agencies to provide funding to hire qualified

17

youth for subsidized employment.

18

(b)  Benefits.--The following shall apply:

19

(1)  Qualified youth may be employed for no more than six

20

weeks at an hourly rate of $9 per hour, unless limited by

21

Federal regulation.

22

(2)  The maximum number of hours for each individual

23

employed under the program shall be 25 hours per week for no

24

more than six weeks.

(c)  Eligibility.--A qualified youth shall be eligible if the

26

youth is unemployed. The receipt of TANF benefits by the

27

qualified youth's parents or legal guardians shall not preclude

28

eligibility.

Section 4.  Powers and duties of the department.

The department shall have the following powers and duties:

(1)  To establish procedures for community-based agencies

2

to apply for the funds available under this act.

(2)  To provide notice to community-based agencies,

4

including Workforce Investment Boards of necessary procedures

5

and requirements to apply for the program. The notice may be

6

posted on the department's Internet website.

(3)  To provide a report within six months from the

8

effective date of this section to the chairman and minority

9

chairman of the Labor and Industry Committee of the Senate

10

and the chairman and minority chairman of the Labor Relations

11

Committee of the House of Representatives, which shall

12

provide an update on the increase in jobs with the

13

implementation of this act. The report shall be made

14

available for public inspection and posted on the

15

department's publicly accessible Internet website.

16

(4)    To audit grants or funds awarded under this act to

17

ensure that funds have been used in accordance with this act

18

and the terms and standards adopted by the department.

19

Section 5.  Funding.

20

No more than 17% of the funds in the Tobacco Product Tax

21

Account shall be used to fund the program.

22

Section 20.  Effective date.

23

This act shall take effect immediately.
