AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

Statutes, in offenses in general, further providing for snow

3

or ice dislodged or falling from moving vehicle.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 3720 of Title 75 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 3720.  Snow and ice [dislodged or falling from moving vehicle]

9

on vehicles.

(a)  Duty to remove.--

11

(1)  Any driver of a motor vehicle being operated on any

12

street or highway of this Commonwealth shall have an

13

affirmative duty to make all reasonable efforts to remove all

14

accumulated ice or snow from the motor vehicle, including the

15

hood, trunk and roof of the motor vehicle.

(2)  Any driver of a motor vehicle who violates this

17

subsection may be stopped on a street or highway by a law

18

enforcement officer if the law enforcement officer believes

the accumulated ice or snow may pose a threat to persons or

2

property.

(3)  Any person who violates this subsection shall be

4

subject to a fine of not less than $25 nor more than $75 for

5

each offense regardless of whether any snow or ice is

6

dislodged from the vehicle.

(b)  Dislodged or fallen snow or ice.--When snow or ice is

8

dislodged or falls from a moving vehicle and strikes another

9

vehicle or pedestrian causing death or serious bodily injury as

10

defined in section 3742 (relating to accidents involving death

11

or personal injury), the operator of the vehicle from which the

12

snow or ice is dislodged or falls shall be subject to a fine of

13

not less than $200 nor more than [$1,000] $1,500 for each

14

offense.

Section 2.  This act shall take effect in 60 days.
