| AN ACT |
| |
1 | Amending the act of July 28, 1988 (P.L.556, No.101), entitled |
2 | "An act providing for planning for the processing and |
3 | disposal of municipal waste; requiring counties to submit |
4 | plans for municipal waste management systems within their |
5 | boundaries; authorizing grants to counties and municipalities |
6 | for planning, resource recovery and recycling; imposing and |
7 | collecting fees; establishing certain rights for host |
8 | municipalities; requiring municipalities to implement |
9 | recycling programs; requiring Commonwealth agencies to |
10 | procure recycled materials; imposing duties; granting powers |
11 | to counties and municipalities; authorizing the Environmental |
12 | Quality Board to adopt regulations; authorizing the |
13 | Department of Environmental Resources to implement this act; |
14 | providing remedies; prescribing penalties; establishing a |
15 | fund; and making repeals," in recycling fee, further |
16 | providing for recycling fee for municipal waste landfills and |
17 | resource recovery facilities. |
18 | The General Assembly of the Commonwealth of Pennsylvania |
19 | hereby enacts as follows: |
20 | Section 1. Section 701(d) of the act of July 28, 1988 |
21 | (P.L.556, No.101), known as the Municipal Waste Planning, |
22 | Recycling and Waste Reduction Act, amended November 9, 2006 |
23 | (P.L.1347, No.140), is amended to read: |
24 | Section 701. Recycling fee for municipal waste landfills and |

3 | [(d) Sunset for fee.--No fee shall be imposed under this | <-- |
4 | section on and after January 1, 2012.] [2012] 2020. | <-- |
5 | Section 2. The act is amended by adding a section to read: | <-- |
6 | Section 707. Used tire pile remediation. |
7 | (a) Funding transfer.--Beginning in fiscal year 2009-2010, |
8 | through and including fiscal year 2012-2013, $1,250,000 shall be |
9 | transferred from the Recycling Fund created under section 706 to |
10 | the Used Tire Pile Remediation Restricted Account established |
11 | under section 110 of the act of December 19, 1996 (P.L.1478, |
12 | No.190), entitled "An act relating to the recycling and reuse of |
13 | waste tires; providing for the proper disposal of waste tires |
14 | and the cleanup of stockpiled tires; authorizing investment tax |
15 | credits for utilizing waste tires; providing remediation grants |
16 | for the cleanup of tire piles and for pollution prevention |
17 | programs for small business and households; establishing the |
18 | Small Business and Household Pollution Prevention Program and |
19 | management standards for small business hazardous waste; |
20 | providing for a household hazardous waste program and for grant |
21 | programs; making appropriations; and making repeals." |
22 | (b) Use of funding.--For fiscal year 2009-2010 through |
23 | fiscal year 2012-2013 moneys in the account shall be used for |
24 | the following purposes: |
25 | (1) The remediation of waste tire piles on the priority |
26 | enforcement list maintained by the department pursuant to |
27 | section 107(a) and (b) of the act of December 19, 1996 |
28 | (P.L.1478, No.190). |
29 | (2) The remediation of waste tire piles on the list of |
30 | additional waste tire sites maintained by the department |

1 | pursuant to section 107(d) of the act of December 19, 1996 |
2 | (P.L.1478, No.190). |
3 | (3) For the award of grants pursuant to section 111 of |
4 | the act of December 19, 1996 (P.L.1478, No.190) for |
5 | remediation of waste tire piles as provided in this |
6 | subsection or for activities authorized under that section |
7 | which the department determines will assist with the |
8 | remediation of waste tire piles as provided in this |
9 | subsection. |
10 | (c) Annual report by department.--No later than December 31, |
11 | 2010, and no later than each December 31 thereafter, the |
12 | department shall provide a report to the Environmental Resources |
13 | and Energy Committee of the Senate, the Appropriations Committee |
14 | of the Senate, the Environmental Resources and Energy Committee |
15 | of the House of Representatives and the Appropriations Committee |
16 | of the House of Representatives on the Used Tire Pile |
17 | Remediation Restricted Account and the remediation of used tire |
18 | piles. The last report to be submitted by the department |
19 | pursuant to this subsection shall be submitted no later than |
20 | December 31, 2014. Within seven days following submission of |
21 | each report to the Senate and House committees, the department |
22 | shall post the report on the department's publicly accessible |
23 | Internet website. The report shall include: |
24 | (1) The current balance of the account and the projected |
25 | balance of the account at the end of the fiscal year for |
26 | which the department's budget is being submitted. |
27 | (2) A listing of waste tire piles remediated or to be |
28 | remediated pursuant to subsection (b) during the prior fiscal |
29 | year and cumulatively since the effective date of this |
30 | subsection. |

1 | (3) Those waste tire piles which the department expects |
2 | to remediate pursuant to subsection (b) during the fiscal |
3 | year for which its budget is being submitted and the |
4 | projected cost for remediation of those waste tire piles. |
5 | (4) Those waste tire piles which will remain to be |
6 | remediated pursuant to subsection (b) and the projected cost |
7 | for remediation of those waste tire piles. |
8 | Section 2 3. This act shall take effect in 60 days. | <-- |
