AN ACT

Amending the act of December 18, 2007 (P.L.486, No.77), entitled

2

"An act providing for the Hazardous Sites Cleanup Fund, for

3

its funding, for expenditures from the fund and for audits of

4

the fund; making an appropriation; and making related

5

repeals," providing for deposit of funds; and further

providing for annual reports.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  Section 6 of the act of December 18, 2007

(P.L.486, No.77), known as the Hazardous Sites Cleanup Funding

11

Act, is amended to read:

12

Section 1.  The act of December 18, 2007 (P.L.486, No.77),

known as the Hazardous Sites Cleanup Funding Act, is amended by

14

adding a section to read:

15

Section 4.1.  Deposit to fund.

16

In addition to money from sources set forth under section

17

901(c) of the act of October 18, 1988 (P.L.756, No.108), known

18

as the Hazardous Sites Cleanup Act, all civil penalties assessed

19

under section 1104 of the Hazardous Sites Cleanup Act shall be

20

deposited into the fund.

Section 2.  Section 6 of the act is amended to read:

Section 6.  Annual report.

3

(a)  Submission and posting.--The annual report required

4

under section 902(c) of the act of October 18, 1988 (P.L.756,

5

No.108), known as the Hazardous Sites Cleanup Act, shall be

6

transmitted by the department to the General Assembly no later

7

than [August] December 31 of each year. The annual report may be

8

submitted to the General Assembly via electronic mail. The

9

department shall also publish and maintain the annual report on

10

the department's publicly accessible Internet website.

(b)  Contents.--In addition to the information required to be

12

submitted under section 902(c) of the Hazardous Sites Cleanup

13

Act, the annual report shall also contain, at a minimum, the

14

following information:

15

(1)  The number and a description of the emergency

16

responses initiated by the department and the costs incurred

17

in the aggregate and for each emergency response.

18

(2)  The number and nature of violations of the Hazardous

19

Sites Cleanup Act and the amount of fines and penalties

20

assessed in the aggregate and for each violation.

21

(3)  The amount expended for personnel costs.

22

Section 2 3.  This act shall take effect in 60 days.
