AN ACT

Amending the act of April 14, 1972 (P.L.221, No.63), entitled,

2

as amended, "An act establishing the Pennsylvania Advisory

3

Council on Drug and Alcohol Abuse; imposing duties on the

4

Department of Health to develop and coordinate the

5

implementation of a comprehensive health, education and

6

rehabilitation program for the prevention and treatment of

7

drug and alcohol abuse and drug and alcohol dependence;

8

providing for emergency medical treatment; providing for

9

treatment and rehabilitation alternatives to the criminal

10

process for drug and alcohol dependence; and making repeals,"

11

further providing for commitment of minors.

The General Assembly of the Commonwealth of Pennsylvania

13

hereby enacts as follows:

14

Section 1.  Section 12.1(b) of the act of April 14, 1972

15

(P.L.221, No.63), known as the Pennsylvania Drug and Alcohol

16

Abuse Control Act, added November 26, 1997 (P.L.501, No.53), is

17

amended to read:

Section 12.1.  Commitment of Minors.--* * *

19

(b)  Upon petition pursuant to subsection (a), the court:

20

(1)  Shall appoint counsel for the minor.

21

(2)  Shall order a minor who is alleged to have a dependency

22

on drugs or alcohol to undergo a drug and alcohol assessment

performed by a psychiatrist, a licensed psychologist with

2

specific training in drug and alcohol assessment and treatment

3

[or], a certified addiction counselor[.], or an employe or agent

4

of a single county authority or an employe or agent of a

5

licensed drug and alcohol treatment entity who has successfully

6

met all training requirements of the Department of Health

7

relating to the most recent edition of the adolescent American

8

Society of Addiction Medicine Patient Placement Criteria or any

9

instrument that is subsequently approved as adolescent placement

10

criteria by the Department of Health, and who has at least one

11

year experience working with adolescents diagnosed with drug and

12

alcohol abuse or addiction or co-occurring substance use and

13

emotional disorders. Such assessment shall include a recommended

14

level of care and length of treatment. [Assessments completed by

15

certified addiction counselors] With the exception of

16

assessments completed by a psychiatrist or licensed

17

psychologist, assessments shall be based on the Department of

18

Health approved drug and alcohol level of care criteria. [and

19

shall be reviewed by a case management supervisor in a single

20

county authority.]

21

The court shall hear the testimony of the persons performing the

22

assessment under this subsection at the hearing on the petition

23

for involuntary commitment.
