| AN ACT |
| |
1 | Amending Title 23 (Domestic Relations) of the Pennsylvania |
2 | Consolidated Statutes, providing for duration of child |
3 | support payments. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 23 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 4328. Duration of child support payments. |
9 | (a) General rule.--Unless expressly provided in an order of |
10 | support, provisions in the order for the support of a child |
11 | shall terminate by emancipation or attainment of majority of the |
12 | child but not by the death of a parent obligated to support the |
13 | child. |
14 | (b) Death of obligee parent.--When a parent obligated to pay |
15 | support dies, the amount of support may be modified, revoked or |
16 | commuted to a lump sum payment, to the extent just and |
17 | appropriate in the circumstances. |
18 | Section 2. This act shall take effect in 60 days. |
