| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in pupils and attendance, further |
6 | providing for residence and right to free school privileges. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. Section 1302 of the act of March 10, 1949 |
10 | (P.L.30, No.14), known as the Public School Code of 1949, is |
11 | amended by adding a subsection to read: |
12 | Section 1302. Residence and Right to Free School |
13 | Privileges.--* * * |
14 | (d) Notwithstanding the provisions of subsection (a), when a |
15 | child lives outside of Pennsylvania as a result of one or both |
16 | parents being called or ordered to active military duty, other |
17 | than active duty training, that child shall continue to be |
18 | considered a resident of the school district that was the |
19 | child's resident school district immediately prior to the parent |

1 | being stationed outside of Pennsylvania, provided that the |
2 | parent maintains the residence. |
3 | Section 2. This act shall take effect immediately. |
