AN ACT

Amending Title 4 (Amusements) of the Pennsylvania Consolidated

2

Statutes, further providing for distributions from the State

3

Gaming Fund to counties of the first class.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 1403(c)(2)(i)(A), (ii)(A) and (iii)(A) of

7

Title 4 of the Pennsylvania Consolidated Statutes are amended to

8

read:

9

§ 1403.  Establishment of State Gaming Fund and net slot machine

10

revenue distribution.

(c)  Transfers and distributions.--The department shall:

(2)  From the local share assessment established in

15

subsection (b), make quarterly distributions among the

16

counties hosting a licensed facility in accordance with the

17

following schedule:

(i)  If the licensed facility is a Category 1

licensed facility that is located at a harness racetrack

2

and the county, including a home rule county, in which

3

the licensed facility is located is:

4

(A)  A county of the first class:  4% of the

5

gross terminal revenue to the county hosting the

6

licensed facility from each such licensed facility.

Notwithstanding any other provision to the contrary,

8

funds from licensed gaming entities located within a

9

county of the first class shall not be distributed

10

outside of a county of the first class. All of the

11

funds distributed to a county of the first class

12

shall be used for any shortfalls in the police and

13

fire budgets first, then the remainder will go into

14

the General Fund.

(ii)  If the licensed facility is a Category 1

17

licensed facility and is located at a thoroughbred

18

racetrack and the county in which the licensed facility

19

is located is:

20

(A)  A county of the first class:  4% of the

21

gross terminal revenue to the county hosting the

22

licensed facility from each such licensed facility.

Notwithstanding any other provision to the contrary,

24

funds from licensed gaming entities located within

25

the county of the first class shall not be

26

distributed outside of a county of the first class.

All of the funds distributed to a county of the first

28

class shall be used for any shortfalls in the police

29

and fire budgets first, then the remainder will go

30

into the General Fund.

(iii)  If the facility is a Category 2 licensed

3

facility and if the county in which the licensed facility

4

is located is:

5

(A)  A county of the first class:  4% of the

6

gross terminal revenue to the county hosting the

7

licensed facility from each such licensed facility.

Notwithstanding any other provision to the contrary,

9

funds from licensed gaming entities located within a

10

county of the first class shall not be distributed

11

outside of a county of the first class. [The first

12

$5,000,000 of the total amount distributed annually

13

to the county of the first class shall be distributed

14

to the Philadelphia School District.] All of the

15

funds distributed to a county of the first class

16

shall be used for any shortfalls in the police and

17

fire budgets first, then the remainder will go into

18

the General Fund.

Section 2.  This act shall take effect in 60 days.
