| AN ACT |
| |
1 | Providing for the Children's Access to Concurrent Care Act and |
2 | for applicability. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Short title. |
6 | This act shall be known and may be cited as the Children's |
7 | Access to Concurrent Care Act. |
8 | Section 2. Definitions. |
9 | The following words and phrases when used in this act shall |
10 | have the meanings given to them in this section unless the |
11 | context clearly indicates otherwise: |
12 | "Child." A person under 19 years of age. |
13 | "Health insurance policy." An individual or group health, |
14 | sickness or accident policy, subscriber contract or certificate |
15 | issued by an entity subject to this act or the following: |
16 | (1) The act of May 17, 1921 (P.L.682, No.284), known as |

1 | The Insurance Company Law of 1921. |
2 | (2) The act of December 29, 1972 (P.L.1701, No.364), |
3 | known as the Health Maintenance Organization Act. |
4 | (3) The act of May 18, 1976 (P.L.123, No.54), known as |
5 | the Individual Accident and Sickness Insurance Minimum |
6 | Standards Act. |
7 | (4) 40 Pa.C.S. Ch. 61 (relating to hospital plan |
8 | corporations) or 63 (relating to professional health services |
9 | plan corporations). |
10 | "Insurer." A company or entity licensed in this Commonwealth |
11 | to issue health insurance policies. |
12 | "Life-prolonging treatment." Treatment addressing the |
13 | underlying disease rather than alleviating symptoms. |
14 | Section 3. Required coverage. |
15 | (a) General rule.-- |
16 | (1) A voluntary election to seek payment for hospice |
17 | care for a child shall not preclude an insured from coverage |
18 | or payment for services related to the treatment of the |
19 | child's condition for which diagnosis of terminal illness has |
20 | been made. |
21 | (2) A health insurance policy providing coverage for |
22 | life-prolonging treatments for children shall also provide |
23 | coverage for hospice care and shall not exclude concurrent |
24 | coverage for the life-prolonging treatment. |
25 | (b) Coverage subject to annual deductible, copayment or |
26 | coinsurance requirements.--The coverage required under this act |
27 | shall be subject to the annual deductible, copayment or |
28 | coinsurance requirements imposed by an entity subject to this |
29 | act for similar coverages under the same health insurance policy |
30 | or contract. |

1 | Section 19. Applicability. |
2 | This act shall apply to health insurance policies issued |
3 | under a group master policy or individual policy delivered or |
4 | issued for delivery on or after the effective date of this act |
5 | and to renewals of such policies on or after the effective date |
6 | of this act. |
7 | Section 20. Effective date. |
8 | This act shall take effect simultaneously with the provision |
9 | for concurrent care for children under Medicaid and the |
10 | Children's Health Insurance Program as specified in section 2302 |
11 | of the Patient Protection and Affordable Health Care Act (P.L. |
12 | 111-148, 124 Stat. 119). |
