| AN ACT |
| |
1 | Relating to education concerning the organic compound bisphenol |
2 | A; and imposing duties on the Department of Health. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Short title. |
6 | This act shall be known and may be cited as the BPA Education |
7 | Act. |
8 | Section 2. Definitions. |
9 | The following words and phrases when used in this act shall |
10 | have the meanings given to them in this section unless the |
11 | context clearly indicates otherwise: |
12 | "Bisphenol A" or "BPA." An organic compound used in the |
13 | manufacturing of plastics with two phenol functional groups |
14 | which is prepared by the condensation of acetone with two |
15 | equivalents of phenol and catalyzed by an acid, such as |
16 | hydrochloric acid or a sulfonated polystyrene resin. |

1 | "County department of health." Any single-county department |
2 | of health or any joint-county department of health created under |
3 | the act of August 24, 1951 (P.L.1304, No.315), known as the |
4 | Local Health Administration Law. |
5 | "Department." The Department of Health of the Commonwealth. |
6 | Section 3. BPA educational program. |
7 | (a) Duties of department and county departments of health.-- |
8 | The following shall apply: |
9 | (1) The department and each county department of health, |
10 | both jointly and individually, shall conduct a continuing |
11 | publicity and education program for the citizens of this |
12 | Commonwealth aimed at informing parents of infants or |
13 | children three years of age or younger of the toxic risks to |
14 | children associated with the use of bisphenol A in |
15 | manufactured bottles, cups or other containers designed or |
16 | indented to be filled with any liquid, food or beverage |
17 | primarily for the consumption from that container by |
18 | children. |
19 | (2) The department shall be authorized to collaborate |
20 | with any public agency or private sector entity to prepare |
21 | public education materials or programs designed to inform |
22 | parents of the toxic risks to children associated with the |
23 | use of bisphenol A in manufactured products. |
24 | (b) Dissemination of information.--The following shall |
25 | apply: |
26 | (1) The department shall provide for the availability of |
27 | and arrange for the appropriate distribution of educational |
28 | material or dissemination of information through all county |
29 | departments of health to educate the public about the toxic |
30 | risks to children associated with the use of bisphenol A in |

1 | manufactured products. |
2 | (2) County departments of health shall distribute |
3 | educational materials and disseminate information explaining |
4 | the toxic risks associated with the use of bisphenol A in |
5 | manufactured products, and may use all current public |
6 | information channels and all relevant Federally funded and |
7 | State-funded community-based programs for maximum |
8 | distribution of information about this act. |
9 | Section 4. Regulations. |
10 | Each county department of health shall promulgate regulations |
11 | within one year of the effective date of this subsection on the |
12 | responsibilities of educating the public about the toxic risks |
13 | associated with the use of bisphenol A in manufactured products. |
14 | Section 5. Effective date. |
15 | This act shall take effect in 60 days. |
