| AN ACT |
| |
1 | Establishing and mandating written disclosures to individuals |
2 | being recruited as student athletes by Pennsylvania colleges |
3 | and universities. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Short title. |
7 | This act shall be known and may be cited as the Student |
8 | Athletes' Right-to-Know Act. |
9 | Section 2. General disclosures to athlete. |
10 | Commencing January 1, 2011, within one week of any personal |
11 | contact with a student athlete for purposes of recruiting the |
12 | student athlete for a collegiate interscholastic athletic |
13 | program, the collegiate athletic recruiter shall provide in |
14 | writing to the student athlete all of the following information: |
15 | (1) A description of the medical insurance policies that |
16 | affect student athletes, including, but not limited to, terms |
17 | of eligibility for medical insurance coverage, covered |
18 | conditions and events, medical premiums, copayments, |

1 | deductibles, maximum benefits and the process for obtaining |
2 | independent medical opinions. |
3 | (2) The total sum of medical payments, including, but |
4 | not limited to, deductibles and copayments, that the |
5 | postsecondary educational institution did not pay for sports- |
6 | related injuries incurred by members of each athletic team in |
7 | each of the last four years. |
8 | (3) Any scheduling conflict between the mandatory |
9 | classes in majors offered at the postsecondary educational |
10 | institution, and the schedule of the athletic team for which |
11 | the student athlete is being recruited, as well as the |
12 | athletic program's policy for how the conflict is resolved. |
13 | (4) The number of student athletes in each academic |
14 | major. |
15 | (5) The number of student athletes who changed majors |
16 | and the names of the original majors. |
17 | (6) Each athletic team's policy concerning the criteria |
18 | for the renewal or nonrenewal of an athletic scholarship, |
19 | including circumstances in which a student athlete suffers a |
20 | temporary or permanent sports-related injury, there is a |
21 | coaching change or a student athlete's athletic performance |
22 | is deemed to be below expectations. |
23 | (7) The average percent of decrease in the dollar amount |
24 | of a renewed one-year athletic scholarship for a temporarily |
25 | injured and a permanently injured student athlete on each |
26 | athletic team for the previous four years. |
27 | (8) The number and percentage of student athletes on |
28 | each athletic team whose scholarships were not renewed in |
29 | each of the previous four years. |
30 | (9) The number of and rate at which student athletes |

1 | with remaining athletic eligibility did not return to each |
2 | athletic team in the previous four years. |
3 | (10) The number of and rate at which student athletes |
4 | from any athletic team with remaining athletic eligibility |
5 | transferred to another school. |
6 | (11) The number of student athletes from any athletic |
7 | team who were denied an intercollegiate transfer request in |
8 | the previous four year. |
9 | (12) The average length of time it took to grant an |
10 | intercollegiate transfer request for any student athlete from |
11 | any athletic team in the previous four years. |
12 | (13) The sum of expenses included in the cost of |
13 | attending the postsecondary educational institution that are |
14 | not included in a full grant-in-aid athletic scholarship for |
15 | the current year and previous three years. |
16 | (14) A summary of the intercollegiate athletic program's |
17 | use of funds that may be used toward assisting student |
18 | athletes with expenses that are not included in a full grant- |
19 | in-aid scholarship. |
20 | (15) The average monthly payment received for an on- |
21 | campus and off-campus full scholarship student athlete |
22 | enrolled in classes in each sport during the regular academic |
23 | and summer sessions in each of the last four years. |
24 | (16) The results of an anonymous annual student athlete |
25 | survey containing student athletes' opinions about the safety |
26 | of their workout environment, academic support and coaches. |
27 | (17) The number of rescinded written scholarship offers |
28 | for each athletic team in each of the previous four years. |
29 | (18) Institutional policies that may restrict the |
30 | athletic eligibility of a student athlete who wishes to |

1 | transfer to another postsecondary educational institution. |
2 | (19) The number of full-scholarship student athletes on |
3 | each athletic team who enrolled in summer school in each of |
4 | the previous four years. |
5 | Section 3. Disclosures to athlete with verbal offer. |
6 | Commencing January 1, 2011, any scholarship offer shall be |
7 | made in writing within one week of a verbal offer and prior to a |
8 | student athlete signing an athletic scholarship agreement with a |
9 | postsecondary educational institution. The written offer shall |
10 | include at least all of the following information: |
11 | (1) Any specific academic qualifications that will |
12 | guarantee the student athlete's enrollment in the |
13 | postsecondary educational institution. |
14 | (2) A description of the medical insurance policies that |
15 | will affect the student athlete, including, but not limited |
16 | to, terms of eligibility for medical insurance coverage, |
17 | covered conditions and events, medical premiums, copayments, |
18 | deductibles, maximum benefits and the process for obtaining |
19 | independent medical opinions. |
20 | (3) Each athletic team's policy and standard practices |
21 | concerning the criteria for the renewal or nonrenewal of an |
22 | athletic scholarship, including circumstances in which a |
23 | student athlete suffers a temporary or permanent sports- |
24 | related injury, there is a coaching change or a student |
25 | athlete's athletic performance is deemed to be below |
26 | expectations. |
27 | (4) The number and percentage of student athletes on the |
28 | team whose scholarship was not renewed in each of the |
29 | previous four years. |
30 | (5) Which expenses, if any, will be paid for by an |

1 | athletic grant or scholarship, including summer school |
2 | expenses. |
3 | (6) Expense items included in the cost of attendance |
4 | that will not be paid for by the postsecondary educational |
5 | institution, including summer school expenses. |
6 | (7) A summary of the intercollegiate athletic program's |
7 | use of funds that may be used toward assisting student |
8 | athletes with expenses that are not included in a full grant- |
9 | in-aid athletic scholarship. |
10 | (8) Which, if any, meals the intercollegiate athletic |
11 | program regularly makes available during the regular academic |
12 | year and during the summer. |
13 | (9) The average monthly deduction, if any, that is |
14 | deducted from a full-scholarship student athlete's payment to |
15 | pay for meals that the intercollegiate athletic program |
16 | regularly makes available during the regular academic year. |
17 | (10) The terms and the amount of any death benefit |
18 | provided by the postsecondary educational institution in case |
19 | of sports-related death. |
20 | (11) Whether or not an athletic scholarship offer will |
21 | expire. |
22 | Section 4. Applicability. |
23 | This act shall apply to athletic scholarship contracts |
24 | entered into after the effective date of this act. |
25 | Section 5. Effective date. |
26 | This act shall take effect in 60 days. |
