AN ACT

  

1

Amending the act of July 9, 1987 (P.L.220, No.39), entitled "An

2

act licensing and regulating the practice of social work;

3

providing penalties; and making an appropriation," further

4

providing for legislative intent, for definitions, for

5

licensure, for the licensing agency and its functions, for

6

licensure qualifications and procedure, for reciprocity and

7

for license reinstatement; providing for restrictions on use

8

of title "Licensed Bachelor Social Worker"; and further

9

proscribing unlawful practice.

The General Assembly of the Commonwealth of Pennsylvania

11

hereby enacts as follows:

12

Section 1.  Section 2 of the act of July 9, 1987 (P.L.220,

13

No.39), known as the Social Workers, Marriage and Family

14

Therapists and Professional Counselors Act, amended December 21,

15

1998 (P.L.1017, No.136), is amended to read:

16

Section 2.  Legislative intent.

17

The practice of social work, marriage and family therapy and

18

professional counseling within this Commonwealth is hereby

19

declared to affect the public safety and welfare and to be

20

subject to regulation and control in the public interest to

protect the public from unprofessional, improper, unauthorized

2

and unqualified practice of licensed bachelor social work, 

3

licensed social work, licensed clinical social work, licensed

4

marriage and family therapy and licensed professional

5

counseling. This act regulates only those who hold themselves

6

out as licensed bachelor social workers, licensed social

7

workers, licensed clinical social workers, licensed marriage and

8

family therapists or as licensed professional counselors.

9

[Acquisition of a license under this act shall not be made a

10

condition of the employment of a person by the Commonwealth or

11

any of its political subdivisions or by nonprofit agencies.]

12

Section 2.  Section 3 of the act is amended by adding

13

definitions to read:

Section 3.  Definitions.

15

The following words and phrases when used in this act shall

16

have the meanings given to them in this section unless the

17

context clearly indicates otherwise:

"Licensed bachelor social worker."  A social worker who holds

20

a current license under this act.

21

"Practice of bachelor social work."  The application of

23

social work theory, knowledge, methods, ethics and the

24

professional use of self to restore or enhance social or

25

psychosocial functioning of individuals, couples, families,

26

groups, organizations or communities. Bachelor social work

27

includes planning, intervention, case management, information

28

and referral, counseling, supervision, consultation, education,

29

advocacy, community organization and the development,

30

implementation and administration of policies, programs and

activities.

Section 3.  Section 4 of the act, amended December 21, 1998

4

(P.L.1017, No.136), is amended to read:

Section 4.  License required.

6

It shall be unlawful for any person to hold himself or

7

herself forth as a licensed bachelor social worker, licensed

8

social worker, licensed clinical social worker, licensed

9

marriage and family therapist or licensed professional counselor

10

unless he or she shall first have obtained a license pursuant to

11

this act.

12

Section 4.  Section 5(a) and (l) of the act, amended December

13

21, 1998 (P.L.1017, No.136), are amended and the section is

14

amended by adding a subsection to read:

15

Section 5.  State Board of Social Workers, Marriage and Family

16

Therapists and Professional Counselors.

17

(a)  Creation.--There is hereby created the State Board of

18

Social Workers, Marriage and Family Therapists and Professional

19

Counselors, a departmental administrative board in the

20

Department of State. The board shall consist of [13] 14 members

21

who are citizens of the United States and who have been

22

residents of this Commonwealth for a two-year period, two of

23

whom shall be public members; five of whom shall be licensed

24

social workers, at least one of whom shall be a licensed

25

clinical social worker [and], at least one of whom shall be a

26

licensed social worker and at least one of whom shall be a

27

licensed bachelor social worker; two of whom shall be licensed

28

marriage and family therapists; two of whom shall be licensed

29

professional counselors; one of whom shall be either a licensed

30

marriage and family therapist or a licensed professional

counselor as hereafter provided; one of whom shall be a

2

representative of the Office of Attorney General; and one of

3

whom shall be the Commissioner of Professional and Occupational

4

Affairs.

(c.1)  Appointment of licensed bachelor social worker.--

7

Within 90 days after the effective date of this subsection, the

8

Governor shall nominate one professional member to serve as a

9

bachelor social worker on the board to serve a three-year term.

10

The bachelor social worker initially appointed to the board

11

pursuant to this section need not have successfully completed

12

the licensure examination adopted by the board but, at the time

13

of appointment, must have satisfied the educational and

14

experience requirements of this act for licensed bachelor social

15

worker.

(l)  Operating procedures.--The board shall meet within 30

18

days after the appointment of its new members and set up

19

operating procedures and develop application forms for licensing

20

bachelor social workers, clinical social workers, marriage and

21

family therapists and professional counselors. It shall be the

22

responsibility of the board to circulate these forms and educate

23

the public to the requirements of licensing in order to hold

24

oneself out as a licensed bachelor social worker, licensed

25

social worker, licensed clinical social worker, licensed

26

marriage and family therapist or licensed professional counselor

27

within the Commonwealth.

Section 5.  Section 6 of the act, amended December 21, 1998

29

(P.L.1017, No.136), is amended to read:

Section 6.  Powers and functions of board.

The board shall have the following powers:

(1)  To pass upon the qualifications and fitness of

3

applicants for licenses and reciprocal licenses and to adopt

4

and revise rules and regulations requiring applicants to pass

5

examinations relating to their qualifications as a

6

prerequisite to the issuance of a license.

7

(2)  To adopt and, from time to time, revise such rules

8

and regulations as may be necessary to carry into effect the

9

provisions of this act. Such regulations may include, but

10

shall not be limited to, standards of professional practice

11

and conduct for licensed bachelor social workers, licensed

12

social workers, licensed clinical social workers, licensed

13

marriage and family therapists and licensed professional

14

counselors in Pennsylvania.

15

(3)  To examine for, deny, approve, issue, revoke,

16

suspend or renew licenses of bachelor social workers, social

17

workers, clinical social workers, marriage and family

18

therapists and professional counselors pursuant to this act

19

and to conduct hearings in connection therewith.

20

(4)  To conduct hearings upon complaints concerning

21

violations of the provisions of this act and the rules and

22

regulations adopted pursuant to this act and seek the

23

prosecution and enjoinder of all such violations.

24

(5)  To expend moneys necessary to the proper carrying

25

out of its assigned duties.

26

(6)  To waive examination and grant a license in cases

27

deemed exceptional by the board and in accordance with

28

regulations promulgated by the board.

29

(7)  To submit annually a report to the Professional

30

Licensure Committee of the House of Representatives and the

Consumer Protection and Professional Licensure Committee of

2

the Senate containing a description of the types of

3

complaints received, status of the cases, board action which

4

has been taken and length of time from the initial complaint

5

to final board resolution.

6

(8)  To submit annually to the Appropriations Committees

7

of the House of Representatives and the Senate, 15 days after

8

the Governor has submitted his budget to the General

9

Assembly, a copy of the budget request for the upcoming

10

fiscal year which the board previously submitted to the

11

Department of State.

Section 6.  Section 7 of the act is amended by adding a

13

subsection to read:

Section 7.  Qualifications for license.

15

(g)  Bachelor social work license.--An applicant shall be

17

qualified for a license to hold oneself out as a licensed

18

bachelor social worker, provided the applicant submits proof

19

satisfactory to the board that:

20

(1)  The applicant:

21

(i)  Is of good moral character.

22

(ii)  Has received a bachelor's degree from an

23

accredited school of social work or social welfare.

24

(iii)  Has passed an examination duly adopted by the

25

board.

26

(iv)  Agrees to adhere to the National Association of

27

Social Workers' Professional Code of Ethics pertaining to

28

the delivery of direct practice social services.

(2)  The application is accompanied by the application

30

fee.

(3)  The applicant has not been convicted of a felony

2

under The Controlled Substance, Drug, Device and Cosmetic Act

3

or of an offense under the laws of another jurisdiction,

4

which, if committed in this Commonwealth would be a felony

5

under The Controlled Substance, Drug, Device and Cosmetic

6

Act, unless:

7

(i)  at least ten years have elapsed from the date of

8

conviction;

9

(ii)  the applicant satisfactorily demonstrates to

10

the board that the applicant has made significant

11

progress in personal rehabilitation since the conviction,

12

such that licensure of the applicant should not be

13

expected to create a substantial risk of harm to the

14

health and safety of the applicant's clients or the

15

public or a substantial risk of further criminal

16

violations; and

17

(iii)  the applicant otherwise satisfies the

18

qualifications contained in or authorized by this act.

19

As used in this paragraph, the term "convicted" shall include

20

a judgment, an admission of guilt or a plea of nolo

21

contendere.

22

Section 7.  Sections 8, 10 and 12 of the act, amended

23

December 21, 1998 (P.L.1017, No.136), are amended to read:

24

Section 8.  Procedures for licensing.

25

(a)  Affidavit required.--Each application form for an

26

applicant submitted to the board for examination or licensure

27

shall have attached as part of the form an affidavit or

28

affirmation for the applicant to complete as to the veracity of

29

the information on the application.

30

(b)  Issuance of license.--The board shall issue to each

person who meets the licensure requirements of this act a

2

certificate setting forth that such person is licensed to hold

3

himself or herself out as a licensed bachelor social worker, a

4

licensed social worker, a provisional social worker, a licensed

5

clinical social worker, a licensed marriage and family therapist

6

or a licensed professional counselor.

Section 10.  Reciprocity.

8

The board shall have the power to grant a reciprocal license

9

to an applicant who is licensed or certified as a bachelor

10

social worker, social worker, clinical social worker, marriage

11

and family therapist or professional counselor in another state

12

and has demonstrated qualifications which equal or exceed those

13

required pursuant to this act in the determination of the board,

14

provided that no license shall be granted under this section to

15

an applicant unless the state in which the applicant is licensed

16

affords reciprocal treatment to persons who are residents of

17

this Commonwealth and who are licensed pursuant to this act.

18

Section 12.  Reinstatement of license.

19

Unless ordered to do so by Commonwealth Court or an appeal

20

therefrom, the board shall not reinstate the license of a person

21

to practice as a bachelor social worker, social worker, clinical

22

social worker, marriage and family therapist or professional

23

counselor pursuant to this act, which has been revoked. Any

24

person whose license has been revoked may apply for

25

reinstatement, after a period of at least five years, but must

26

meet all of the licensing qualifications of this act, including

27

the examination requirement, if he or she desires to practice as

28

a bachelor social worker, social worker, clinical social worker,

29

marriage and family therapist or professional counselor pursuant

30

to this act at any time after such revocation.

Section 8.  The act is amended by adding a section to read:

2

Section 16.4.  Restrictions on use of title "Licensed Bachelor

3

Social Worker."

4

Only individuals who have received licenses as licensed

5

bachelor social workers under this act may style themselves as a

6

licensed bachelor social worker and use the letters "L.B.S.W."

7

in connection with their names, and it shall be unlawful for an

8

individual to style himself or herself as a licensed bachelor

9

social worker or use any words or symbols indicating or tending

10

to indicate that the individual is a licensed bachelor social

11

worker without holding a license in good standing under this

12

act.

Section 9.  Section 20 of the act, amended December 21, 1998

14

(P.L.1017, No.136) and July 9, 2008 (P.L.929, No.68), is amended

15

to read:

16

Section 20.  Unlawful practice.

17

(a)  Unlawful practice prohibited.--It shall be unlawful for

18

any person to hold himself or herself out as a licensed bachelor

19

social worker, licensed social worker, licensed clinical social

20

worker, marriage and family therapist and professional counselor

21

without possessing a valid, unexpired, unrevoked and unsuspended

22

license issued under this act.

23

(a.1)  Title.--It shall be unlawful for an individual to hold

24

oneself out as a social worker, use the title of "social worker"

25

or use the abbreviation of "S.W." without meeting the definition

26

of "social worker." This subsection includes advertising as a

27

social worker and adopting or using any title or description of

28

services incorporating the term "social worker" and their

29

related abbreviations, which implies directly or indirectly that

30

the individual is a social worker. This subsection shall not

apply to the following individuals:

(1)  An individual employed by the Commonwealth in a

3

social work position on the effective date of this

4

subsection, during the time of employment by the

5

Commonwealth.

6

(2)  An individual employed as a school social worker in

7

a public or private school in this Commonwealth on or before

8

the effective date of this subsection, during the time of

9

employment as a school social worker.

10

(b)  Injunction.--Unlawful practice may be enjoined by the

11

courts upon petition of the commissioner or the board. In any

12

proceeding under this section, it shall not be necessary to show

13

that any person is individually injured by the actions

14

complained of. If the court finds that the respondent has

15

violated this section, it shall enjoin him or her from so

16

practicing until he or she has been duly licensed. Procedure in

17

such cases shall be the same as in any other injunction suit.

18

(c)  Remedy cumulative.--The injunctive remedy provided in

19

this section shall be in addition to any other civil or criminal

20

prosecution and punishment.

21

Section 10.  This act shall take effect in 180 days.
