| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, in falsification and intimidation, |
3 | further providing for the offense of false reports to law |
4 | enforcement authorities. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 4906(b) of Title 18 of the Pennsylvania |
8 | Consolidated Statutes is amended, subsection (c) is amended by |
9 | adding a paragraph and the section is amended by adding a |
10 | subsection to read: |
11 | § 4906. False reports to law enforcement authorities. |

13 | (b) Fictitious reports.--Except as provided in subsection |
14 | (c), a person commits a misdemeanor of the third degree if [he] |
15 | the person: |
16 | (1) reports to law enforcement authorities an offense or |
17 | other incident within [their] the person's concern knowing |
18 | that it did not occur; or |
19 | (2) pretends to furnish such authorities with |

1 | information relating to an offense or incident when [he] the |
2 | person knows [he] the person has no information relating to |
3 | such offense or incident. |
4 | (c) Grading.-- |

6 | (3) If the violation of subsection (a) or (b) relates to |
7 | a false report that was made with the intent to maliciously |
8 | discredit a specific race, color, religion, national origin, |
9 | ethnicity or gender, the offense shall be graded one step |
10 | greater than that set forth in the applicable subsection. |
11 | (d) Restitution.--In addition to any other penalty |
12 | authorized by law, a person who violates this section shall, |
13 | upon conviction, be sentenced to pay restitution to any law |
14 | enforcement agency equal to the amount of services provided by |
15 | the law enforcement authority to investigate the false report. |
16 | Section 2. This act shall take effect in 60 days. |
