AN ACT

Making appropriations from the restricted revenue accounts

within the State Gaming Fund and from the State Gaming Fund

3

to the Pennsylvania Gaming Control Board, the Department of

4

Revenue, the Pennsylvania State Police and the Attorney

5

General for the fiscal year beginning July 1, 2009, to June

6

30, 2010, and for the payment of bills incurred and remaining

7

unpaid at the close of the fiscal year ending June 30, 2009.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

PART I

PRELIMINARY PROVISIONS

Section 101.  Short title.

13

This act shall be known and may be cited as the Gaming

14

Control Appropriation Act of 2009.

PART III

STATE GAMING CONTROL

RESTRICTED REVENUE ACCOUNTS

Section 301.  State Gaming Fund.--The following amounts set

19

forth in this part, or as much thereof as may be necessary, are

20

hereby appropriated from the State Gaming Fund restricted

21

revenue accounts under 4 Pa.C.S. § 1401 (relating to slot

machine licensee deposits) to the agencies of the Executive

2

Department named in this part for the purposes set forth for the

3

fiscal year beginning July 1, 2009, and for the payment of bills

4

incurred and remaining unpaid at the close of the fiscal year

5

ending June 30, 2009.

Section 302.  Attorney General.--The following

amounts are appropriated to the Attorney General:

For salaries, wages and all necessary expenses

of the Attorney General related to 4 Pa.C.S. Pt.

Section 303.  Department of Revenue.--The

following amounts are appropriated to the

Department of Revenue:

For the salaries, wages and all necessary

expenses of the Department of Revenue related to 4

Section 304.  Pennsylvania State Police.--The

following amounts are appropriated to the

Pennsylvania State Police.

For the salaries, wages and all necessary

expenses of the Pennsylvania State Police related

STATE GAMING FUND

Section 501.  State Gaming Fund.--The following amounts set

forth in this part, or as much thereof as may be necessary, are

hereby appropriated from the State Gaming Fund to the agencies

of the Executive Department named in this part for the purposes

set forth for the fiscal year beginning July 1, 2009, and for

3

the payment of bills incurred and remaining unpaid at the close

4

of the fiscal year ending June 30, 2009.

Section 502.  Pennsylvania Gaming Control

Board.--The following amounts are appropriated to

the Pennsylvania Gaming Control Board.

For the salaries, wages and all necessary

expenses for the proper operation and

administration of the Pennsylvania Gaming Control

Board. This appropriation includes $8,113,000 from

the restricted revenue account established in the

State Gaming Fund for fees and other revenues

Section 503.  Loan.--Unrestricted funds appropriated to the

17

Pennsylvania Gaming Control Board under this part in the amount

18

of $26,417,500 shall constitute a loan and shall be repaid in

19

the manner set forth in section (Upon enactment, the Legislative

20

Reference Bureau shall replace this blank with the appropriate

21

citation.) of the act of April 9, 1929 (P.L.343, No.176), known

22

as The Fiscal Code. The board shall defer assessing slot machine

23

licensees for repayment until such time as 11 slot machine

24

licenses have been issued and 11 licensed gaming entities have

25

commenced the operation of slot machines.

PART VII

MISCELLANEOUS PROVISIONS

28

Section 701.  Transfers prohibited.--There is no authority

29

for the State Treasurer, the Secretary of the Budget, the

30

Secretary of Revenue or the Pennsylvania Gaming Control Board to

transfer any money within or between the appropriations in Part

2

III or Part V.

Section 702.  Effective date.--This act shall take effect

4

July 1, 2009, or immediately, whichever is later.
