AN ACT

Amending the act of October 17, 2008 (P.L.1645, No.132),

2

entitled "An act providing for the regulation of home

3

improvement contracts and for the registration of certain

4

contractors; prohibiting certain acts; and providing for

5

penalties," further providing for procedures for registration

6

as a contractor.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  Section 4(a)(1)(i) and (ix) of the act of October

10

17, 2008 (P.L.1645, No.132), known as the Home Improvement

11

Consumer Protection Act, are amended to read:

12

Section 4.  Procedures for registration as a contractor.

(a)  Application.--

14

(1)  A person shall apply to the bureau in writing or

15

electronically via a secure Internet connection, if permitted

16

by the bureau, on a form provided by the bureau. The

17

application shall include the following information:

(i)  For an individual applicant, all of the

19

following:

(A)  Name.

(B)  Date of birth.

(C)  Home address and home telephone number.

3

(D)  Driver's license number [or], a copy of an

4

identification card issued by the state in which the

5

individual resides or other form of identification as

6

permitted by the bureau.

7

(E)  Business name, address and telephone number.

8

(F)  Federal employer identification number, if

9

applicable.

10

(G)  Social Security number.

11

(H)  All prior business names and addresses of

12

home improvement businesses operated by the

13

individual.

(ix)  Proof of liability insurance covering personal

16

injury in an amount not less than $50,000 and insurance

17

covering property damage caused by the work of a home

18

improvement contractor in an amount not less than

19

$50,000. For purposes of this subparagraph, proof of

20

insurance may include information attested to by an

21

applicant indicating that the applicant is self-insured

22

for religious purposes, and the bureau shall promulgate

23

and make available forms for this purpose.

Section 2.  This act shall take effect July 1, 2009, or

26

immediately, whichever is later.
