AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," further providing for limitations on

6

certain unreserved fund balances.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  Section 688 of the act of March 10, 1949 (P.L.30,

10

No.14), known as the Public School Code of 1949, is amended by

11

adding a subsection to read:

Section 688.  Limitations on Certain Unreserved Fund

13

Balances.--* * *

(a.1)  A school district may exceed the ending unreserved,

15

undesignated fund balance limits set by subsection (a) for the

16

purpose of accumulating funds for projected employer

17

contribution rate increases for Public School Employees'

Retirement System members. The provisions of this subsection

2

shall be exempt from referendum requirements under the act of

3

June 27, 2006 (1st Sp.Sess., P.L.1873, No.1), known as the

4

Taxpayer Relief Act. The provisions of this subsection shall

5

expire five years from the effective date of this subsection.
