| AN ACT |
| |
1 | Amending Title 24 (Education) of the Pennsylvania Consolidated |
2 | Statutes, further providing for Public School Employees' |
3 | Retirement Board. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 8501(a) of Title 24 of the Pennsylvania |
7 | Consolidated Statutes is amended to read: |
8 | § 8501. Public School Employees' Retirement Board. |
9 | (a) Status and membership.--The board shall be an |
10 | independent administrative board and shall consist of [15] the |
11 | following members: the Secretary of Education, ex officio; the |
12 | State Treasurer, ex officio; two Senators; two members of the |
13 | House of Representatives; the executive secretary of the |
14 | Pennsylvania School Boards Association, ex officio; [two] three | <-- |
15 | to be appointed by the Governor, [at least one of whom shall not | <-- |
16 | be a] none of whom shall be either a current or former school | <-- |
17 | employee or an officer or employee of the State, and who must | <-- |

1 | possess financial, investment or legal experience; three to be |
2 | elected by the active professional members of the system from |
3 | among their number; [one] three to be elected by annuitants from |
4 | among their number; one to be elected by the active |
5 | nonprofessional members of the system from among their number; |
6 | and [one] two to be elected by members of Pennsylvania public | <-- |
7 | school boards from among their number. The appointments made by |
8 | the Governor shall be confirmed by the Senate and each election |
9 | shall be conducted in a manner approved by the board. The terms |
10 | of the appointed and nonlegislative elected members shall be |
11 | three years. The members from the Senate shall be appointed by |
12 | the President pro tempore of the Senate and shall consist of one |
13 | member from the majority and one member from the minority. The |
14 | members from the House of Representatives shall be appointed by |
15 | the Speaker of the House of Representatives and shall consist of |
16 | one member from the majority and one member from the minority. |
17 | The legislative members shall serve on the board for the |
18 | duration of their legislative terms and shall continue to serve |
19 | until 30 days after the convening of the next regular session of |
20 | the General Assembly after the expiration of their respective |
21 | legislative terms or until a successor is appointed for the new |
22 | term, whichever occurs first. The chairman of the board shall be |
23 | elected by the board members. Each ex officio member of the |
24 | board, each elected member of the board and each legislative |
25 | member of the board may appoint a duly authorized designee to |
26 | act in his stead. The designee appointed by a member elected by |
27 | the active professional members of the system must be an active |
28 | professional member of the system. The designee appointed by a |
29 | member elected by annuitants must be an annuitant. The designee |
30 | appointed by a member elected by the active nonprofessional |

2 | of the system. The designee appointed by a member elected by |
3 | members of the Pennsylvania public school boards must be a |
4 | member of a Pennsylvania public school board. |

6 | Section 2. Nothing in this act shall preempt or supersede |
7 | the terms of a collective bargaining agreement in effect on the |
8 | effective date of this act for the term of that collective |
9 | bargaining agreement unless otherwise agreed to in writing by |
10 | the parties to the collective bargaining agreement. |
11 | Section 3. This act shall take effect in 30 days December | <-- |
