AN ACT

Amending Title 62 (Procurement) of the Pennsylvania Consolidated

2

Statutes, providing for cost-benefit analysis; and further

3

providing for powers and duties.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 62 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 109.  Cost-benefit analysis.

9

(a)  General rule.--Except as otherwise provided under

10

subsection (b), a contract involving property, real, personal or

11

mixed of any kind or description or any contract for personal

12

services where the consideration involved is $50,000 or more

13

shall not be implemented and no supplies, services or

14

construction shall be accepted or work begun until a cost-

15

benefit analysis of the contract is completed by the purchasing

16

agency.

(b)  Applicability.--The provisions of subsection (a) shall

not apply where:

2

(1)  there is a threat to public health, welfare or

3

safety; or

4

(2)  there are circumstances outside the control of the

5

Commonwealth agency that create an urgency of need that does

6

not permit the delay involved for the completion of a cost-

7

benefit analysis.

(c)  Publication of cost-benefit analysis.--The purchasing

9

agency shall file with the Treasury Department a copy of the

10

cost-benefit analysis prepared under this section. The analysis

11

shall be available for inspection at no charge with the

12

corresponding contracts on the Treasury Department's publicly

13

accessible Internet website as required under section 1702 of

14

the act of February 14, 2008 (P.L.6, No.3), known as the Right-

15

to-Know Law.

Section 2.  Section 321 of Title 62 is amended by adding a

17

paragraph to read:

18

§ 321.  Powers and duties.

19

Except as otherwise specifically provided in this part, the

20

department shall have the following powers and duties:

21

(7)  Complete a cost-benefit analysis of each contract

23

awarded when the department acts as the purchasing agency.

24

Section 3.  This act shall take effect in 60 days.
