AN ACT

  

1

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," prohibiting cyber charter schools

6

from charging school districts for programs or services not

7

provided by the school district.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

Section 1.  Section 1743-A(a) of the act of March 10, 1949

11

(P.L.30, No.14), known as the Public School Code of 1949, added

12

June 29, 2002 (P.L.524, No.88), is amended to read:

13

Section 1743-A.  Cyber charter school requirements and

14

prohibitions.

15

(a)  Special financial requirements prohibited.--A cyber

16

charter school shall not:

17

(1)  provide discounts to a school district or waive

18

payments under section 1725-A for any student;

19

(2)  except as provided for in subsection (e), provide

20

payments to parents or guardians for the purchase of

instructional materials; [or]

2

(3)  except as compensation for the provision of specific

3

services, enter into agreements to provide funds to a school

4

entity[.]; or

5

(4)  require payment from school districts for classes,

6

programs or services not provided by the school district.

Section 2.  This act shall take effect in 60 days.
